Abstract

Penulisan skripsi ini bertujuan untuk mengetahui pelaksanaan perjanjian antara driver angkutan online dengan perusahaan angkutan ojek online yang bersangkutan dan untuk mengetahui Perlindungan Hukum Terhadap Penumpang Jasa Ojek Online. Penelitian ini diharapkan dapat menambah wawasan dalam pemahaman hukum pada umumnya dan di bidang hukum perjanjian khususnya yang berkaitan dengan Perlindungan Konsumen. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Jenis penelitian yuridis empiris merupakan pendekatan yang menganalisis permasalahan dilakukan dengan cara memadukan bahan-bahan hukum (yang merupakan data sekunder) dengan data primer yang diperoleh di lapangan ataupun observasi. Penelitian dengan yuridis empiris secara garis besar ditujukan kepada penelitian terhadap sifat keberlakuan asas-asas hukum, sistematika hukum, dan taraf sinkronisasi hukum. Jenis penelitian yuridis empiris mengacu kepada penelitian lapangan atau observasi terhadap keberlakuan norma-norma hukum yang terdapat dalam peraturan perundang-undangan, putusan-putusan pengadilan, maupun perjanjian-perjanjian serta norma-norma hukum yang ada dalam masyarakat. Penelitian ini sampai pada kesimpulan yaitu pelaksanaan perjanjian antara driver angkutan online dengan perusahaan angkutan ojek online adalah bersifat kemitraan artinya antara driver dan penyedia jasa angkutan online berkedudukan sebagai mitra. Hubungan kedudukan kemitraan itu sendiri di dasarkan pada perjanjian antara driver dan penyedia jasa angkutan online yang berlandasakan Pasal 1338 KUHPerdata. Perlindungan hukum terhadap penumpang jasa angkutan ojek online tidak dapat dilepaskan dari UUPK,. Terkait perlindungan data elektronik dan penggunaan informasi elektronik maka perlindungan hukum penumpang jasa angkutan ojek online didasarkan pada Undang-Undang No 19 Tahun 2016 perubahan atas Undang-Undang No 11 Tahun 2008 tentang informasi dan transaksi elektronik sedangkan terkait jasa pengangkutan maka penumpang jasa angkutan ojek online dilindungi oleh UULLAJ./ This thesis aims to understand the implementation of the agreement between online transportation driver and the concerned online transportation service company and to understand The Legal Protection of Online Transportation Passengers. This case study is expected to add more perceptions on the understanding of law in general and in the field of agreement law in particular related to customer protection. This case study research method is juridical empirical. Juridical empirical case study is to analyze problems by combining method in legal material (which is the secondary data) with the primary data obtained from the field or observation. The case study by juridical empirical is aimed for research on the validity of legal principles, legal systematics, and the level of legal synchronization. The type of juridical empirical case study refers to field research or observation of the validity of legal norms which are found in law regulations, the verdict of jurisdiction, as well as agreements and existing legal norms in society. This study comes to the conclusion that the implementation of the agreement between online transportation driver and online transportation service company are partnership meaning that between driver and online transportation service provider are partners. The partnership itself is based on an agreement between drivers and online transportation service provider based on Section 1338 of criminal code. Legal protection of online transportation passenger cannot be liberated from the law of customer protection. Regarding electronic data protection and the usage of electronic information accordingly the legal to protect online transportation passengers is based on law number 19 of 2016 amendment to law number 11 of 2008 concerning information and electronic transaction whereas for transportation services, online transport passengers are protected under law of traffic and road transport.
