Abstract

Penelitian yang terkait dengan Akibat Hukum Yang Timbul Dari Akta Jual Beli Tanah Bermasalah Yang Diterbitkan Oleh Notaris PPAT ini bertujuan untuk mengetahui bagaimana tata cara penerbitan akta jual beli tanah, faktor yang menyebabkan terbitnya akta jual beli tanah bermasalah, serta untuk mengetahui bagaimana akibat hukum yang ditimbulkan dari akta bermasalah yang diterbitkan oleh notaris PPAT. Penelitian ini menggunakan jenis penelitian yuridis normatif yaitu dengan menggunakan sumber data sekunder yang merupakan data-data dari dokumen resmi, jurnal maupun perundang-undangan dengan cara pengumpulan data melalui studi kepustakaan atau library research yang kemudian dianalisa dengan menggunakan meode deskriptif analitis. Selain itu, data juga dikumpulkan penulis melalui field research yaitu dengan melakukan wawancara dengan ahli atau praktisi hukum yang dalam hal ini yaitu Notaris PPAT. Hasil yang diperoleh dari penelitian ini yaitu Tata cara Penerbitan akta Jual beli tanah oleh notaris PPAT ialah dimulai dengan pemeriksaan dan melangkapi syarat-syarat administrasi yang diperlukan, faktor penyebab akta jual beli bermasalah dapat disebabkan oleh banyak pihak antara lain berasal dari PPAT Notaris pembuat akta itu sendiri dimana lalai dalam menjalankan tugasnya atau mengabaikan ketentuan yang berlaku, maupun faktor eksternal dari para pihak dimana para pihak kurang memahami prosedur dan syarat yang perlu dilengkapi untuk pembuatan suatu akta jual beli, serta juga faktor administrasi yang menyebabkan terjadinya akta jual beli tanah bermasalah. Akibat terhadap akta itu sendiri yaitu kekuatan pembuktiannya terdegradasi menjadi akta di bawah tangan tetapi meskipun aktanya terdegradasi, perjanjian jual beli tersebut tetap sah sepanjang syarat subyektif dan syarat obyektif perjanjian terpenuhi. / The research related to the legal consequences from problematic land deed by land deed official notary aims to find out about how the procedure of the land deed is, what the factors causing the problematic land deed are, and what the legal consequences from problematic land deed by land deed official notary are. This research uses normative juridical research by using secondary data sources which are data from official documents, journals and legislation by collecting data through library research which is then analyzed using descriptive analytical methods. Other than that, the data is also gathered by the author through field research which is by doing interviews with experts or legal practitioners which in this case is PPAT notary. The results obtained from this research are the procedure of land land deed by notary, which starts with inspection and completion of the administrative requirements that are necessary, the factors which cause problems to land deed can be affected by many parties, such as the Land Deed Official Notary who made the deed themselves who negligent in carrying out their duties or ignoring the legal procedures, external factors from the parties which do not understand the procedures and the conditions that are needed to be fulfilled in order to make a land deed, as well as administrative factors that cause problematic deeds. The consequences of the land deed itself is that the power of the evidence is degraded to a deed that is only applied to the parties which sign it. But even though the deed is degraded, the sale and purchase contract is still valid as long as the subjective and objective terms of the contract are fulfilled.
