Abstract

Sesuai ketentuan UUJN, Notaris mempunyai hak cuti yang dapat diambil setelah Notaris menjalankan jabatannya selama 2 (dua) tahun, dan selama menjalankan cuti, Notaris wajib menunjuk seorang Notaris Pengganti yang akan menerima protokol Notaris dan melaksanakan tugas-tugas jabatan Notaris. Tesis ini bertujuan untuk menganalisis pengaturan mengenai sumber kewenangan, tugas, dan tanggung jawab Notaris Pengganti dan kekuatan pembuktian akta yang dibuatnya, serta pertanggungjawabannya apabila akta yang dibuat mengandung cacat materiil. Metode yang digunakan adalah normatif empiris. Hasil penelitian menunjukkan bahwa sumber kewenangan Notaris Pengganti diperoleh secara atribusi melalui UUJN dan secara delegasi dari Notaris yang digantikannya. Secara normatif, tugas dan tanggung jawab Notaris Pengganti memiliki lingkup yang sama dengan Notaris yang digantikannya, yaitu mencakup : kedudukan hukum, wewenang membuat akta, pengangkatan, kewajiban, larangan, tanggung jawab dalam pelaksanaan jabatan, dan penerapan sanksi. Akta-akta yang dibuat oleh Notaris Pengganti mempunyai kekuatan pembuktian yang sama dengan akta-akta Notaris yang digantikannya. Notaris Pengganti juga bertanggung jawab apabila akta yang dibuatnya terdegradasi menjadi akta di bawah tangan dan batal demi hukum karena mengandung cacat materiil, dalam hal Notaris Pengganti tidak terlibat maka ia tidak bertanggung jawab karena bersifat pasif dalam kewenangannya membuat akta autentik. Apabila terlibat secara sadar dan sengaja, maka secara hukum Notaris Pengganti dapat digugat atas perbuatan melawan hukum dan secara pidana, dapat dituntut atas tindak pidana pemalsuan surat. Berdasarkan putusan yang berkekuatan hukum tetap, Notaris Pengganti dikenakan sanksi kode etik berupa sanksi pemberhentian dengan tidak hormat oleh Menteri Hukum dan HAM sehingga tidak dapat melaksanakan jabatannya sebagai Notaris kembali. / In accordance with UUJN, the Notary has the right of off duty that can be taken after the Notary has carried out his position for 2 (two) years, and during the absence, the Notary shall appoint a Substitute Notary who will accept the Notary's protocol and carry out the duties of the Notary. This thesis aims to analyze the arrangements regarding the source of authority, duties, and responsibilities of the Substitute Notary and the strength of proof of the deed he made, as well as his accountability if the deed made contains material defects. The method used is empirical normative. The results showed that the source of the authority of the Substitute Notary was obtained through attribution through UUJN and by delegation from the Notary he replaced. Normatively, the duties and responsibilities of Substitute Notaries have the same scope as the Notary they replace, which includes : legal position, authority to make deeds, appointments, obligations, prohibitions, responsibilities in carrying out positions, and application of sanctions. The deeds made by the Substitute Notary have the same evidentiary power as the Notarial deeds which they have replaced. The Substitute Notary is also responsible if the deed he makes is degraded into a deed under the hand and null and void by law because it contains material defects, in the event that the Substitute Notary is not involved, he is not responsible because it is passive in his authority to make an authentic deed. If involved consciously and intentionally, then the Substitute Notary can be sued for acts against the law and criminal, can be prosecuted for the crime of falsification of the letter. Based on a decision that has permanent legal force, the substitute notary will be subject to a code of ethics sanction in the form of an irreverent termination by the Minister of Justice and Human Rights so that he cannot carry out his position as a notary again.
