Abstract

Perumahan dan pemukiman merupakan kebutuhan dasar setiap manusia. Dengan semakin bertambahnya penduduk, maka pembangunan rumah dibuat bertingkat atau yang dikenal dengan rumah susun. Pembangunan rumah susun merupakan salah satu alternatif pemecahan masalah kebutuhan perumahan dan pemukiman terutama di daerah perkotaan. Akhir-akhir ini banyak masalah hukum berhubungan dengan rumah susun, salah satunya terjadi di Apartemen Slipi yang telah diputus oleh pengadilan dalam Putusan PTUN nomor 182/G/2012/PTUN-JKT (“Putusan No. 182”). Berawal dari permohonan perpanjangan Sertipikat Hak Guna Bangunan Apartemen Slipi yang diajukan oleh Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun Apartemen Slipi yang tidak diproses oleh Badan Pertanahan Nasional Provinsi DKI Jakarta yang mengakibatkan berakhirnya sertipikat Hak Guna Bangunan atas tanah tersebut (“SHGB”). Dengan hapusnya hak atas tanah bersama tersebut maka secara otomatis tanah tersebut kembali menjadi tanah negara, sementara di apartemen Slipi sebanyak 276 Sertipikat Hak Milik atas Satuan Rumah Susun (“SHMSRS”) telah diterbitkan. Hal ini mengakibatkan ketidakpastian hukum terhadap 276 SHMSRS tersebut. Rumusan masalah dalam penelitian ini adalah (i) Bagaimana kepastian hukum terhadap SHMSRS akibat berakhirnya SHGB tanah bersama yang dimaksud? (ii) Bagaimana putusan majelis hakim dalam Putusan No. 182 ditinjau dari asas keadilan, asas kemanfaatan, dan asas kepastian hukum? Penelitian ini menggunakan metode yuridis normatif. Pendekatan yang digunakan di dalam penelitian ini adalah pendekatan kasus dan pendekatan peraturan perundang-undangan. Dari hasil penelitian tersebut, disimpulkan bahwa (i) Eksistensi atau kepastian hukum atas 276 SHMSRS yang telah diterbitkan menjadi tidak jelas dengan diperbaharuinya SHGB; (ii) Menurut penilaian Penulis, Putusan 182 lebih condong kepada pemenuhan unsur keadilan dan kemanfaatan, tetapi lemah dalam pemenuhan asas kepastian hukum, walaupun bukan berarti tidak memperhatikan asas kepastian hukum. / Housing and habitation are the basic needs of every human being. As the population increased, then the construction of the house is made storeyed or known as an apartment. The development of the apartment became an alternative solution to the problem of housing and habitation needs, especially in the suburban. Lately, there are many legal issues related to the apartment, one of which occurred in the Slipi Apartment which has been decided by a court in State Administrative Court number 182/G/2012/PTUN-JKT (“Decision 182”). It started when the DKI Jakarta Land Office didn’t proceed with the renewal of Rights to Build Certificate of the Slipi Apartment (“SHGB”). With the expiration of the common land, automatically the rights revert to the state land, while 276 strata title (“Strata Title”) have been issued. This causing legal uncertainty towards the 276 Strata Title. The core issues of this research are (i) What is the legal certainty on the Strata Title towards due to the expiration of the SHGB of the common land as mentioned? (ii) What are the verdict of the judges in Decision 182 in terms of the principle of justice, the principle of benefit, and the principle of legal certainty? This research uses the normative juridical method. The approach used in this research is the case approach and the statute approach. The result of the research can be concluded that (i) the existence of legal certainty of the issued 276 Strata Title is unclear with the renewal of the SHGB; (ii) According to the Author’s judgment, Decision 182 is more inclined to the fulfillment of the elements of justice and benefit, but it is weak in fulfilling the principle of legal certainty, although that does not mean do not observe the principle of legal certainty.
