Abstract

Jual beli merupakan suatu perjanjian dengan mana pihak yang satu mengikatkan dirinya untuk menyerahkan suatu kebendaan dan pihak yang lain untuk membayar harga yang telah dijanjikan. Dalam perkembangannya landasan hukum mengenai jual beli terus mengalami perubahan, sehingga dirasa perlu untuk melakukan penelitian terhadap suatu kasus. Kasus yang akan dibahas dalam penulisan ini adalah transaksi jual beli tanah dan bangunan yang dibuat tanpa persetujuan istri atau mantan istri. Berdasarkan tersebut penulis merasa perlu dilakukan penelitian lebih lanjut terkait dengan keabsahan dokumen dalam transaksi jual-beli yang dilakukan tanpa persetujuan istri atau mantan istri ditinjau dari sudut pandang Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria dan Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan dengan menelaah suatu kasus nyata yang terjadi dalam kehidupan sehari-hari untuk lebih mengetahui dan memahami kesesuaian aturan dengan praktik yang terjadi saat ini. Dalam penelitian yuridis normatif ini, pengumpulan data dilakukan dengan penelitian kepustakaan dengan pendekatan asas-asas hukum, serta menggunakan jenis data sekunder berupa bahan hukum primer, sekunder, dan tersier. Dari hasil penelitian tersebut, dapat disimpulkan bahwa terdapat banyak aspek yang dapat mempengaruhi keabsahan dokumen dalam transaksi jual beli, salah satunya adalah pembuatan perjanjian kawin dan persetujuan istri. / Purchase and sale is an agreement with which one party binds itself to submit a material and the other party to pay the price that has been promised. In its development the legal basis for purchase and sale continues to change, so it is felt necessary to conduct research on a case. The case to be discussed in this paper is the sale and purchase of land and buildings made without the consent of his wife or former wife. Based on this, the author feels that further research is needed related to the validity of documents in transactions carried out without the consent of his wife or former wife in terms of the perspective of the Civil Code, Law Number 5 of 1960 Concerning Basic Rules Agraria and Law Number 1 of 1974 concerning Marriage by examining a real case that occurs in everyday life to better know and understand the suitability of the rules with current practice. In this normative juridical study, data collection is done by library research using the principles of the law, and using secondary data types in the form of primary, secondary and tertiary. From the results of this research, it can be concluded that there are many aspects that can affect the validity of documents in a sale and purchase transaction, one of which is the making of a marriage agreement and wife's approval.
