Abstract

Penelitian ini bertujuan untuk mengetahui hubungan pelaku usaha dan konsumen dalam melakukan transaksi jual beli melalui media internet, mekanisme jual beli melalui media internet dan perlindungan hukum terhadap konsumen terkait perjanjian jual beli produk melalui internet yang merugikan konsumen. Penelitian ini meggunakan metode penelitian yang bersifat normatif empiris yaitu pendekatan dengan cara membandingkan fakta yang ada di lapangan dengan teori-teori kepustakaan yang berkaitan dengan penelitian ini. Sumber data yang digunakan dalam penelitian ini adalah data primer berupa wawancara dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data dalam penelitian ini dilakukan melalui studi pustaka baik dari buku maupun jurnal hukum yang berkaitan dengan permasalahan serta melakukan wawancara melalui pertanyaan yang terstruktur dan spontan dengan narasumber. Data yang telah penulis dapatkan akan dianalisis secara deskriptif kualitatif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian yang diperoleh dari penulisan ini antara lain pertama, hubungan pelaku usaha dan konsumen dalam jual beli melalui internet merupakan hubungan kontraktual secara perdata berdasarkan prinsip-prinsip yang diatur dalam KUHPerdata terkait dengan hak dan kewajiban para pihak dalam perjanjian jual beli yang berkaitan dengan Undang-Undang PerlindunganKonsumen, sedangkan media transaksi jual beli hubungan pelaku usaha dan konsumen berkaitan dengan Undang-Undang Informasi dan Transaksi Elektronik. Kedua, mekanisme jual beli melalui media internet adalah transaksi jual beli yang dilakukan melalui toko online atau e-commerce dan media elektronik lainnya, dimana konsumen melakukan penawaran atau melalui toko jual beli elektronik, yang kemudian sepakat terhadap harga yang telah di tentukan maka, akan dikirim kepada pembeli atau konsumen setelah pembeli atau konsumen melakukan pembayaran. Ketiga, perlindungan hukum terhadap konsumen terkait perjanjian jual beli produk melalui internet yang merugikan konsumen dapat diproses melalui upaya-upaya hukum secara litigasi maupun non litigasi apabila konsumen merasa di rugikan dan apabila konsumen atau pelaku usaha tidak mencapai mediasi melalui lembaga penyelesaian sengketa tersebut, maka sengketa dapat dinaikkan ke Pengadilan Negeri. / This study aims to determine the relationship of business actors and consumers in buying and selling transactions through the internet media, buying and selling mechanisms through the internet media and legal protection against consumers related to the sale and purchase agreement of products via the internet that harms consumers. This research uses empirical normative research method which is an approach by comparing the facts in the field with library theories related to this research. Source of data used in this study are primary data in the form of interviews and secondary data consisting of primary legal materials, secondary legal materials, tertiary legal materials. Data collection techniques in this research were carried out through literature studies both from books and legal journals relating to the problem and conducting interviews through structured and spontaneous questions with the speakers. The data that I have obtained will be analyzed descriptively qualitatively to get answers to the problems. Research results obtained from this writing among others, first, the relationship between business actors and consumers in buying and selling through the internet is a contractual relationship in a civil manner based on the principles stipulated in the Civil Code related to the rights and obligations of the parties in the sale and purchase agreement relating to the Consumer Protection Act, whereas the transaction media sale and purchase of business and consumer relations with regard to the Information and Electronic Transactions Law. Second, the mechanism of buying and selling through internet media is buying and selling transactions carried out through online stores or e-commerce and other electronic media where consumers make offers or through electronic buying and selling stores, which then agree to the price that has been determined then, will be sent to buyer or consumer after the buyer or consumer makes a payment. Third, the legal protection of consumers related to the sale and purchase agreement of products through the internet that harms consumers can be processed through legal efforts in litigation and non-litigation if consumers feel disadvantaged and if consumers or business actors do not reach mediation through the dispute resolution agency, the dispute can be raised to the District Court.
