Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana upaya penyelesaian kredit macet antara nasabah dengan Bank Mandiri Syariah Cabang Ringroad Medan dan bagaimana eksekusi terhadap objek jaminan apabila kredit macet sudah tidak terselamatkan. Penelitian ini menggunakan metode penelitian yang bersifat normatif empiris yaitu pendekatan dengan cara membandingkan fakta yang ada di lapangan dengan teori – teori kepustakaan yang berkaitan dengan penelitian ini. Sumber data yang digunakan dalam penelitian ini adalah data primer berupa wawancara dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, bahan hukum tersier. Teknik pengumpulan data dalam penelitian ini dilakukan melalui wawancara melalui pertanyaan yang terstuktur dan spontan dengan narasumber untuk mengetahui terkait penyelesaian terhadap kredit macet. Hasil penelitian dan pembahasan kemudian dianalisis secara deskriptif kualitatif untuk memperoleh jawaban atas permasalahan. Hasil penelitian dari penyelesaian kasus kredit macet pada Bank Mandiri Syariah Cabang Ringroad Medan adalah dilakukan dengan negosiasi terlebih dahulu oleh petugas bank yang berkompeten di bidang kredit dengan nasabah untuk melakukan negosiasi dan dinilai apakah kredit tersebut dapat direstukturisasi sesuai yang tercantum dalam Peraturan Bank Indonesia Nomor 13/9/PBI/2011 tentang Perubahan Atas Peraturan Bank Indonesia Nomor 10/18/PBI/2008 tentang Restrukturisasi Pembiayaan Bagi Bank Syariah dan Unit Usaha Syariah. Apabila tidak berhasil maka selanjutnya nasabah diberi kesempatan menjual objek jaminannya dalam jangka waktu 6 bulan, apabila tidak berhasil terjual maka pihak bank akan membantu penjualan objek jaminan dan apabila terjual maka akan dilakukan penandatanganan akta otentik di notaris. Jika semua upaya dalam penjualan objek jaminan tidak berhasil maka bank terpaksa mengambil langkah terakhir berupa lelang dan objek jaminan didaftarkan di Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) / This research aims to determine how the efforts to settle bad credit between customers with Bank Mandiri Syariah Ringroad Medan Branch and how the execution of the object of collateral if bad credits are not saved. This research uses descriptive normative research method which is an approach by comparing facts in the field with literary theories related to this research. Source of data used in this research are primary data in the form of interviews and secondary data consisting of primary legal materials, secondary legal materials, tertiary legal materials. Data collection techniques in this research were conducted through interviews through structured and spontaneous questions with informants to find out related to the settlement of bad credit. The results of the research and discussion were then analyzed descriptively qualitatively to obtain answers to problems. The results of the research concluded that settlement of the bad credit case at Bank Mandiri Syariah Branch Ringroad Medan will be carried out by prior negotiation by bank officers who are competent in the field of credit with credit recipients to negotiate and assess whether the credit can be restructured according to what is stated in Bank Indonesia Regulation Number 13/9 / PBI / 2011 concerning Amendments to Bank Indonesia Regulation Number 10/18 / PBI / 2008 concerning Financing Restructuring for Syariah Banks and Syariah Business Units. If it is not successful then the credit recipient will then be given the opportunity to sell the collateral object within a period of 6 months, if it fails to sell, the bank will assist the sale of the collateral object and if it is sold, an authentic deed will be signed at a notary public. If all efforts in the sale of collateral are unsuccessful, the bank is forced to take the final step in the form of an auction where the bank will auction the collateral object through the Office of State Assets and Auction Services (KPKNL).
