Abstract

Notaris merupakan pejabat umum yang berwenang untuk membuat akta otentik yang bentuknya telah ditentukan oleh undang-undang, Akta notariil atau akta otentik mempunyai kekuatan pembuktian yang sempurna. Akta pengakuan hutang merupakan salah satu akta yang dibuat oleh notaris. Dalam pembentukan akta pengakuan hutang biasanya terdapat klausula jaminan. Jaminan dapat berubah benda bergerak maupun tidak bergerak. Apabila benda bergerak seperti kendaraan bermotor maka jaminannya berupa jaminan fidusia, jaminan berupa hak atas tanah maka jaminannya berupa pembebanan hak tanggungan sedangkan kapal laut berbobot 20m3 dan pesawat terbang dijaminkan dengan hipotek. Studi kasus Putusan Mahkamah Agung Nomor 318K/PDT/2009 akta pengakuan hutang menggunakan jaminan berupa hak atas tanah akan tetapi menggunakan surat kuasa menjual. Maka akta pengakuan hutang harus batal demi hukum dan jaminan yang telah dijual oleh kreditur harus dikembalikan kepada debitur. Pada dasarnya apabila jaminan hak atas tanah dibebankan hak tanggungan maka pada saat debitur cidera janji, kreditur dapat melakukan eksekusi terhadap jaminan tersebut. Notaris berperan penting dalam menentukan akta apa yang digunakan untuk suatu perbuatan yang diingin oleh para pihak. Dengan batal demi hukum suatu akta maka notaris dapat dikenakan sanksi berupa peringatan tertulis, pemberhentian sementara, pemberhentian dengan hormat maupun secara tidak hormat ditambah dengan kerugian yang dialami oleh para pihak. / Notary is a public official who is authorized to make an authentic deed whose form has been determined by law, notarial deed or authentic deed has a perfect proof of strength. The debt acknowledgement deed is a deed made by a public notary. In establishing the deed of debt acknowledgments, there is usually a guarantee clause. Guaranteed to change movable or immovable objects. If a moving object such as a motorized vehicle, the collateral is in the form of fiduciary collateral, collateral in the form of land rights, the collateral is in the form of encumbrance while the ship weighs 20m3 and the aircraft is secured by a mortgage. The study case of the Supreme Court's Decision Number 318K/PDT/2009 debt acknowledgments deed using collateral in the form of land rights but using a power of attorney to sell. Then the debt acknowledgments deed must be null and void by law and the collateral sold by the creditor must be returned to the debtor. Basically, if the guarantee of land rights is borne by the mortgage, when the debtor is in default, the creditor can execute the guarantee. Notaries play an important role in determining what deed is used for an act desired by the parties. With the null and void deed of a deed, the notary may be subject to sanctions in the form of written warnings, temporary terminations, honorably or dishonorable dismissals plus losses suffered by the parties.
