Abstract

Penelitian “Konsekuensi hukum Berakhirnya Hak guna bangunan Menjadi Hak milik (Studi Kasus Putusan Nomor:49/G/2017/PTUN.SBY)” ini memiliki tujuan, pertama untuk mengetahui cara peralihan Hak Guna Bangunan Menjadi Hak Milik dan kedua untuk mengetahui akibat hukum yang tibul pada Hak Guna Bangunan yang habis masa berlakunya. Metode penelitian yang di gunakan oleh penulis dalam peneliti ini adalah yuridis normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka sebagai bahan dasar untuk menelusuri, mengkaji, meneliti data sekunder yang diperoleh dari studi pustaka berupa peraturan perundang-undangan, buku, jurnal serta literatur lainnya yang berkaitan dengan materi penelitian. Hasil yang diperoleh dari penelitian ini pertama, cara peralihan Hak Guna Bangunan menjadi Hak Milik melalui jual beli, tukar menukar, Penyertaan dalam Modal, Hibah, Pewarisan, kedua akibat yang timbul pada Hak Guna Bangunan yang habis masa berlakunya Hak Guna Bangunan atas tanah negara mengakibatkan tanahnya menjadi tanah Negara, Hak Guna Bangunan atas tanah Hak pengelolaan mengakibatkan tanahnya kembali kedalam penguasaan pemegang hak pengelolaan, Hak Guna Bangunan atas hak milik mengakibatkan tanahnya mengakibatkan tanahnya kembali kedalam penguasaan pemegang hak milik./The study "Legal Consequences of the Expiration of Building Rights Into Property Rights (Case Study of Decision Number: 49 / G / 2017 / PTUN.SBY)" has a purpose, first to find out how to transfer the Right to Build into Ownership and second to find out the legal consequences comes the Building Use Rights that expire. The research method used by this researcher is normative juridical, i.e. legal research conducted by researching library material as a basic for tracing, studying, examining secondary data obtained from literature study in the form of legislation, book, journals and other literature related to research material. The results obtained from this study are first, how to transfer Building Rights to Property Rights through the sale and purchase, exchange, Participation in Capital, Grants, Inheritance, secondly the consequences arising on the Right to Building for which the validity of Building Rights over the state land has resulted the land becomes State land, Building Use Rights over land Management rights result in the land being returned to the control of the holder of management rights, Building Use Rights over the ownership rights result in the land causing the land to return to the ownership rights of the owner.
