Abstract

Penelitian ini bertujuan untuk mengetahui implementasi program BPJS Ketenagakerjaan di BPJS Cabang Kota Pekanbaru, khususnya program Jaminan Kecelakaan Kerja, dan untuk menggambarkan faktor-faktor penghambat pelaksanaan Jaminan Kecelakaan Kerja, serta memberikan solusi mengatasi hambatan pelaksanaan Jaminan Kecelakaan Kerja terhadap pekerja di BPJS Ketenagakerjaan Cabang Kota Pekanbaru apabila mengalami kecelakaan kerja, sehingga perlindungan hukum pekerja terwujud. Metode penelitian, jenis penelitian adalah penelitian hukum empiris. Bentuk penelitian ini merupakan penelitian diagnostik, dilanjutkan dengan penelitian preskriptif dan evaluatif. Jenis dan sumber data adalah data primer yang diperoleh langsung di lapangan, dan data sekunder diperoleh dari bahan hukum primer, sekunder dan tertier. Teknik pengumpulan data melalui wawancara dan penyebaran kuesioner kepada responden Pegawai BPJS Ketenagakerjaan Cabang Kota Pekanbaru, pemberi kerja dan pekerjanya yang ditetapkan secara purposive sample, serta penelusuran kepustakaan. Data penelitian dikumpulkan dan dikelompokkan ditelaah dan dianalisis secara kualitatif. Hasil penelitian ini adalah implementasi Program Jaminan Kecelakaan Kerja di BPJS Ketenagakerjaan Cabang Kota Pekanbaru dari segi kepesertaan perusahaan masih belum optimal, khususnya pekerja sektor informal, masih banyak pekerja yang belum terlindungi dari resiko kecelakaan kerja. Klaim manfaat JKK telah terlaksana dengan baik. Faktor-faktor penghambatnya: faktor internal pekerja, yaitu kesadaran perusahaan dan pekerja untuk mendaftarkan diri menjadi peserta BPJS Ketenagakerjaan masih belum maksimal, data adminstrasi pekerja kurang lengkap, keterbatasan pengetahuan dan kemampuan pekerja. Faktor eksternal, program BPJS Ketenagakerjaan belum tersosialisasi dengan baik, SDM petugas BPJS Ketenagakerjaan yang belum memadai, pembebanan iuran JKK, JKM, JHT dan JP untuk kepada pekerja sektor informal tidak mudah. Solusi mengatasinya: peningkatan kesadaran pemberi kerja mendaftarkan dirinya dan seluruh pekerjanya menjadi peserta BPJS Ketenagakerjaan serta ketaatan membayar iuran, sosialisasi tentang kewajiban administrasi pekerja dan proses klaim JKK kepada pekerja, peningkatan pengetahuan dan kemampuan pekerja tentang manfaat program, pemungutan iuran pekerja informal secara adil, tidak mengganggu ekonomi usaha, efesien, dan sistem pemungutan iuran sederhana / This research aims to determine the implementation of the Employment BPJS program in Pekanbaru City BPJS, specifically the Work Accident Guarantee program, to find out and describe the inhibiting factors for the implementation of Work Accident Insurance, and provide solutions to overcome barriers to the implementation of Occupational Accident Insurance for workers in the BPJS Employment Branch in Pekanbaru City when experiencing a work accident, so that the legal protection of workers is realized. Research method, this type of research is empirical legal research. The form of this research is diagnostic research, followed by prescriptive and evaluative research. Types and sources of data are primary data obtained directly in the field, and secondary data obtained from primary, secondary and tertiary legal materials. Data collection techniques through interviewing and distributing questionnaires to respondents Employees of BPJS Employment in Pekanbaru City Branch, employers and workers are determined by purposive sample, as well as library search. Research data are collected and grouped and analyzed and analyzed qualitatively. The results of this study are the implementation of the Work Accident Program in the BPJS Employment in Pekanbaru City Branch in terms of company participation is still not optimal, especially informal sector workers, there are still many workers who have not been protected from the risk of workplace accidents. JKK benefit claims have been implemented well. The inhibiting factors: internal factors of workers, namely the awareness of companies and workers to enroll as BPJS Employment participants are still not optimal, data on workers administration is incomplete, limited knowledge and ability of workers. External factors, the BPJS Employment program has not been well-socialized, the inadequate human resources of BPJS employees, the imposition of JKK, JKM, JHT and JP contributions for informal sector workers are not easy. Solution to overcome this: increased awareness of employers registering themselves and all workers becoming BPJS Employment participants and obedience to paying contributions, socialization of workers' administrative obligations and processing of JKK claims to workers, increased knowledge and ability of workers about program benefits, fair collection of informal worker contributions, not disrupting the business economy, efficiency, and a simple fee collection system
