Abstract

Penelitian ini bertujuan untuk mengetahui akibat hukum yang timbul dari pengesahan putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 terhadap perjanjian kawin di Indonesia, model perjanjian kawin setelah perkawinan berlangsung di Indonesia pasca putusan Mahkamah Konstitusi serta untuk mengetahui status kepemilikan hak atas tanah dari warga negara Indonesia pelaku perkawinan campuran tanpa perjanjian kawin pasca putusan Mahkamah Konstitusi. Penelitian ini menggunakan metode penelitian yang bersifat yuridis normatif dengan pendekatan kasus yang dilakukan dengan meneliti keputusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 dan peraturan perundang-undangan lain yang berkaitan dengan permasalahan. Data yang diteliti dalam penelitian ini adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data penelitian dilakukan melalui studi pustaka yang bersumber dari buku maupun jurnal hukum yang berkaitan dengan permasalahan. Data yang penulis peroleh kemudian akan dianalisis secara kualitatif deduktif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa perjanjian kawin pasca putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 mengalami perubahan yang signifikan. Putusan ini mengakibatkan perubahan Pasal 29 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan yang sebelumnya mengatur bahwa perjanjian kawin hanya dapat dibuat sebelum perlangsungan perkawinan (Prenuptial Agreement). Setelah pengesahan putusan, perjanjian kawin dapat dibuat kapan saja, baik sebelum maupun sesudah perkawinan berlangsung (Postnuptial Agreement). Postnuptial agreement harus dibuat oleh notaris dan hanya meliputi harta-harta yang diperoleh setelah perjanjian dibuat. Harta yang telah menjadi objek jaminan kredit harus dikecualikan dalam perjanjian dan format perjanjian harus memerhatikan norma dan itikad baik demi mewujudkan kepastian hukum bagi semua pihak yang terkait. Berkat putusan ini juga warga negara Indonesia pelaku perkawinan campuran tanpa perjanjian kawin yang sebelumnya tidak dapat memiliki hak milik dan hak guna bangunan karena pembulatan harta bersama, akhirnya telah dapat memiliki hak tersebut dengan cara membuat perjanjian kawin melalui notaris yang kemudian disahkan oleh pegawai pencatat perkawinan. / This research is conducted to determine what legal consequences that emerge because of The Constitutional Court decision number 69/Statutory Regulation-XIII/2015 on marital agreement in Indonesia, to learn about the model of marital agreement that was made after the marriage and to find out the impact of The Constitutional Court decision to the right of lands of the Indonesians that proceed mixed marriage without the marital agreement beforehand. This research uses normative juridical research methods with judicial case study by analyzing The Constitutional Court decision number 69/Statutory Regulation-XIII/2015 and another legislations relating to the problems in this research. The type of data that was analyzed in this research is secondary data consists of primary legal material, secondary legal material, and tertiary legal material. Research data collection technique is obtained through library research both from books and legal journals relating to the problems. Then data that author has obtained was analyzed qualitatively deductively to get answers of the problems. The research results showed that, legal consequences of marital agreement after The Constitutional Court decision number 69/Statutory Regulation-XIII/2015 undergo significant change. This decision inflict the change of Article 29 of Law Number 1 Year 1974 concerning marriage that previously regulate that marital agreement only can be made before the marriage was held (Prenuptial Agreement). After endorsement of the decision, marital agreement can be make whenever the marriage couples wanted to, before the marriage or after the marriage was held (Postnuptial Agreement). Postnuptial agreement must be made by notary and only include assets that were obtained after the agreement was made. Assets that have been object of credit guarantees must be excluded from the agreement and the format of the agreement must be made according to the norms and good faith so the agreement won’t inflict any problem for all party. Indonesians that held their marriage without making prenuptial agreement cannot obtain the land rights that include freehold title and building rights title, finally due to this decision they were able to have these rights by making a postnuptial agreement through a notary that must be endorsed by the marriage registrar.
