Abstract

Untuk melakukan pengawasan terhadap Notaris, dibentuklah suatu badan yang melakukan pengawasan khusus terhadap Notaris yaitu Majelis Pengawas Notaris. Majelis Pengawas yang terbagi atas Majelis Pengawas Daerah, Majelis Pengawas Wilayah dan Majelis Pengawas Pusat memiliki tugas dan fungsi masing-masing. Majelis Pengawas Daerah (Selanjutnya disebut MPD) merupakan dasar utama pengawasan yang dilakukan terhadap Notaris. Namun kini, penipuan mempunyai banyak modus operandi, diantaranya dengan cara menjadi Notaris tidak berizin. Notaris tidak berizin yang dimaksud adalah notaris illegal atau palsu yang melakukan penipuan terhadap orang lain dengan mengaku-ngaku sebagai Notaris asli dengan cara mengambil sertifikat tanah klien lalu dibalik nama dengan atas nama Notaris illegal tersebut yang tentunya hal tersebut mencoreng nama baik lembaga kenotariatan. Sebagai lembaga pengawas notaris dikaitkan dengan adanya kasus tersebut, penelitian ini membahas mengenai bagaimana peran dan tanggungjawab MPD terhadap adanya notaris tidak berizin serta bagaimana kewenangan MPD penjatuhan sanksi yang diberikan kepada Notaris tidak berizin tersebut. Tujuan dari penelitian adalah untuk mengetahui dan menganalisis bagaimana peran serta tanggungjawab dan bagaimana hak penjatuhan sanksi oleh MPD kepada notaris tidak berizin. Pendekatan penelitian yang digunakan Normatif Empiris, yaitu mempelajari peraturan perundang-undangan yang berlaku, MPD dan hukum pidana serta melakukan wawancara kepada narasumber yang relevan dengan penelitian ini. Hasil penelitian ini adalah MPD tidak berperan langsung karena dalam UU MPD tidak mempunyai kewenangan namun MPD dapat berperan dalam membantu korban untuk membuat laporan kepada Lembaga kepolisian jika ada pengaduan, yang kedua MPD juga tidak mempunyai kewenangan untuk menjatuhkan sanksi. / A monitoring institution was formed to do supervision towards public notaries, i.e Notary Supervisory Council which divided into Regional Supervisory Council, District Supervisory Council and Central Supervisory Council that has respective duties and functions. Regional Supervisory Council (referred to MPD in Bahasa) is the basic of supervision conducted towards notaries. But now, there are many frauds with various modus operandi, such as being unlicensed notary.What is meant of being unlicensed notary is illegal notary (can be also referred to fake notary) who does fraud to people by self-claiming as legal notary and taking the client’s land certificate then reverse its name to the illegal notary’s name, which of course tarnishing the good name of notary institution. As notary supervision institutions which associate into the case, this research is discussing about the roles and responsibilities of MPD towards the unlicensed notary and also the MPD’s authority of giving punishment to the unlicensed notary. The purpose of this research is to know and to analyze the roles and responsibilities also the right of imposing punishment by MPD towards the unlicensed notary. The research approach used is Normative Empirical, that is learning the applicable laws and the result of this research is MPD does not have direct role because there is no authority mentioned on the MPD Constitutional, but MPD can take role in helping victims to make report to the police institution if there is any complaint, MPD also does not have authority to impose punishment.
