Abstract

Salah satu syarat pemberian kredit adalah dengan adanya jaminan kredit, dimana didalam dunia perbankan dikenal 2 (dua) macam jaminan kredit, yaitu first way out dan second way out. Jaminan first way out adalah barang, proyek, piutang yang dibiayai oleh bank, sedangkan jaminan second way out adalah jaminan tambahan kebedaan milik debitur. Salah satu jaminan second way out adalah tanah milik debitur, yang diikat dengan Hak Tanggungan, dimana dalam prakteknya dimungkinkan bank tidak mendapatkan sertifikat secara langsung, sehingga untuk meyakinkan bank, maka debitur mengajukan ke BPN Surat Keterangan Pendaftaran Tanah (SKPT). Dalam penelitian ini, jenis penelitian yang digunakan adalah penelitian hukum normatif, dengan pendekatan perundang-undangan dan perbandingan. Dari hasil penelitian tersebut, disimpulkan bahwa apabila keabsahan SKPT sebagai salah satu syarat pencairan kredit adalah dapat menjadi pelanggaran terhadap Pasal 8 Undang-undang Perbankan dan merupakan Perbuatan Melawan Hukum, apabila seorang analis dan pemutus kredit, hanya menggunakan SKPT sebagai dasar keyakinan mereka terhadap suatu agunan, bukan sebagai bukti kepemilikan hak atas tanah, yang dapat berakibat hukum pencairan kredit menjadi cacat hukum. Bank dalam memilih calon debitur, harus diseleksi mana yang memiliki jaminan yang dapat diikat secara sempurna, karena seorang bankir dan pihak lain yang terlibat (Notaris) dapat dinyatakan lalai dan melakukan perbuatan melawan hukum, karena tidak secara hati-hati dalam melaksanakan pencairan kredit. / One of the conditions for granting credit is the existence of credit guarantees, in the world of banking there are 2 (two) types of credit guarantees, first way out and second way out. First way out collateral is goods, projects, receivables financed by banks, while second way out guarantees are additional guarantees of debtor's property. One of the guarantees for the second way out is the debtor's land, which is bound by Mortgage, which in practice makes it possible for banks not to get certificates directly, so to convince the bank, the debtor submits to the BPN Land Registration Certificate (SKPT). In this study, the type of research used is normative legal research, with a legislative and comparative approach. it was concluded that if the SKPT validity as one of the conditions for credit disbursement is a violation of Article 8 of the Banking Law, if an analyst and credit breaker, only uses the SKPT as a basis for their confidence in a collateral, not as proof of ownership of land rights, which can result in legal disbursement of credit to be legally flawed. Banks in selecting prospective debtors, must be selected which have collateral that can be bound perfectly, because a banker and other parties involved (Notaries) can be declared negligent, because they are not careful in carrying out credit disbursements.
