Abstract

Perkembangan dunia khususnya ekonomi pasar berpengaruh hubungan kerja yang semakin fleksibel, salah satunya adalah sistem alih daya. Penelitian ini bertujuan untuk menggambarkan hak dan kewajiban pekerja dalam hubungan kerja dengan sistem alih daya dan analisis implementasi perlindungan hukum terhadap hak-hak normatif pekerja tersebut di People’s Place Café Medan termasuk di masa pandemi covid-19 berdasarkan ketentuan Hukum Ketenagakerjaan yang berlaku. Jenis penelitian ini adalah penelitian hukum normatif-terapan yang bersifat deskriptif karena bertujuan untuk menggambarkan implementasi ketentuan Hukum Ketenagakerjaan dalam sistem alih daya. Metode pengumpulan data melalui studi kepustakaan (library research) dan penelitian lapangan (field research). Teknik pengumpulan data melalui wawancara dengan pihak terkait sistem alih daya, yaitu perusahaan pemberi jasa, perusahaan penerima jasa, dan pekerja alih daya, dan studi dokumen. Penelitian ini menggunakan pendekatan undang-undang dan konseptual, analisis menggunakan metode analisis kualitatif deskriptif dengan logika berpikir deduktif. Hasil penelitian ini dapat disimpulkan bahwa perlindungan hak-hak normatif pekerja alih daya PT. GDP yang dipekerjakan di People’s Place Café belum sepenuhnya mengimplementasikan Hukum Ketenagakerjaan. Sebagian hak pekerja alih daya, yaitu hak waktu kerja, cuti dan izin tidak masuk kerja yang tetap dibayar upahnya, pembayaran upah lembur, K3 dan peningkatan keterampilan melalui pelatihan kerja telah sesuai dengan ketentuan hukum yang berlaku. Hak-hak dasarnya yang justru belum terlindungi, yakni pembayaran upah di bawah UMP, hak kepesertaan dalam program jaminan BPJS Ketenagakerjaan, hak di masa pandemi covid-19 yaitu THR Keagamaan hanya diberikan sebesar 50% upah, hak atas upah selama dirumahkan tidak dibayar dan tidak ada kepastian untuk dapat bekerja kembali serta tidak ada kepastian akan kelangsungan pekerjaan sebab seluruhnya diikat dengan PKWT. Perlindungan hukum untuk menyelesaikan sengketa hak-hak pekerja yang dirumahkan, di PHK atau upah di bawah UMP adalah melalui perundingan bipartit, mediasi/konsiliasi dan mengajukan gugatan ke Pengadilan Hubungan Industrial. / The development of the world, especially in the market economy has increased the working relationship flexibility, which is the outsourcing system. The aim of this research is to describe the rights and worker obligations in the working relationship with outsourcing system and the analysis of the implementation of legal protection of the workers normative rights at the People’s Place Cafe Medan during the pandemic Covid-19 based on the applicable labor law. The type of this research is normative-applied law. This research is a descriptive research, which aims to describe the implementation of labor law provisions in the outsourcing system. This data collected by using library research and field research methods. This research is done by collecting information by using interview with parties related to the outsourcing system, which are the provider of the service company, service recipients, outsourcing workers, and document studies. This research uses statutory approach and conceptual approach. The method used in this research is qualitative method of descriptive analysis with the logic of deductive thinking. The result of this research is the protection of worker’s normative outsourcing rights of PT. GDP that employed at the People’s Place Café Medan has not fully implementing the labor law. Some of the rights of outsourced workers are working hour rights, leave and permission to not attend but the wages are still paid, payment of overtime wages, K3 and skills improvement through job training have been in accordance with legal provisions. The basic rights are not yet protected, which are payment of wages under UMP, participation rights in BPJS Employment Assurance Program, the rights during the pandemic covid-19 period which religious THR is given only 50% of wages, the rights of the wages while working from home is unpaid and there is no assurance to be able to work again and there is no certainty of the continuity of work because it is entirely tied with PKWT. The legal protections for resolving the rights disputes of workers being deployed, at LAYOFFS or wages under the UMP are through bipartite negotiations, mediation/conciliation and submit a lawsuit to the Industrial relations Court.
