Abstract

Penelitian ini bertujuan untuk mengetahui status perwakilan negara asing pada kasus pemutusan hubungan kerja dalam Putusan MA RI No. 376 K/Pdt.Sus-PHI/2013 dan untuk menggambarkan penerapan hukum penyelesaian pemutusan hubungan kerja pada kasus dalam Putusan tersebut. Penelitian ini adalah hukum normatif-empiris yang mengkaji penerapan ketentuan hukum ketenagakerjaan pada kasus PHK dalam Putusan MA RI No. 376 K/Pdt.Sus-PHI/2013. Sifat penelitian ini deskriptif analisis. Jenis data adalah data sekunder berupa bahan hukum primer yakni perundang-undangan dan Putusan MA yang menjadi objek penelitian, bahan hukum sekunder serta tertier dari berbagai literatur. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang dan pendekatan konseptual, metode analisisnya adalah kualitatif. Hasil penelitian, bahwa berdasarkan Konvensi Wina Tahun 1961 juncto UU RI No. 1 Tahun 1982 perwakilan negara asing di Indonesia memiliki kekebalan hukum terhadap hukum Negara Indonesia. Perbuatan hukum yang dilakukan di wilayah yurisdiksi Kedutaan Besar Brazil di Jakarta adalah Hukum Brazil, sehingga Kedutaan Brazil bukan pemberi kerja/pengusaha. Menurut Pasal 1 angka 4 UU Ketenagakerjaan status Kedutaan Brazil adalah pemberi kerja. Penerapan Hukum dalam Penyelesaian kasus PHK WNI yang bekerja pada Kedutaan Brazil di Jakarta pada Putusan MA RI No. 376 K/Pdt.Sus-PHI/2013 adalah : penerapan Hukum Formil telah sesuai UU No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Hukum Materil yang diterapkan pada penyelesaian kasus PHK ini adalah UU No. 13 Tahun 2003 tentang Ketenagakerjaan, Hukum Internasional tentang kekebalan diplomatik dan yurisdiksi Hukum Negara Brazil tidak diterapkan dalam kasus ini. Pemberian kompensasi kepada Pekerja WNI telah sesuai dengan Pasal 156 ayat (2), (3) dan (4) juncto Pasal 151 ayat (3) juncto Pasal 155 ayat (1) dan (2) UU Ketenagakerjaan. / This research aims to determine the status of representatives of foreign countries in the case of termination of employment in the Supreme Court Decree No. RI. 376 K / Pdt.Sus-PHI / 2013 and to illustrate the application of the law on the termination of employment in the case in the Decision. This research is a normative-empirical law that examines the application of the provisions of labor law in the case of layoffs in the Court Decree No. RI. 376 K / Pdt.Sus-PHI / 2013. The nature of this research is descriptive analysis. The type of data is secondary data in the form of primary legal materials namely legislation and Supreme Court Decisions which are the object of research, secondary legal materials and tertiary material from various literatures. The approach used in this research is the law approach and conceptual approach, the method of analysis is qualitative. The results of this research, that based on the 1961 Vienna Convention juncto Law RI No. 1 of 1982 representatives of foreign countries in Indonesia have legal immunity against the laws of the State of Indonesia. Legal actions carried out in the jurisdiction of the Brazilian Embassy in Jakarta are Brazilian Law, so that the Brazilian Embassy is not an employer / entrepreneur. According to Article 1 number 4 of the Manpower Act the status of the Brazilian Embassy is an employer. Application of Law in the Settlement of Termination of employment relationship case of Indonesian workers who work at the Brazilian Embassy in Jakarta is related to the Decree of the Republic of Indonesia Supreme Court No. 376 K / Pdt.Sus-PHI / 2013. The application of formal law is according to Law No. 2 of 2004 concerning Settlement of Industrial Relations Disputes. The material law applied in this termination of employment relationship case is Law No. 13 of 2003 concerning Manpower, International Law on diplomatic immunity and the jurisdiction of the Brazilian State Law are not applied in this case. The granting of compensation to Indonesians Workers is in accordance with Article 156 paragraph (2), (3) and (4) juncto Article 151 paragraph (3) juncto Article 155 paragraph (1) and (2) Labor Law.
