Abstract

Bertumbuhnya kegiatan Perbankan mendorong perlunya Bank untuk menerapkan pengelolaan yang baik pada aspek operasionalnya ketika mengatasi keraguan para pemegang kepentingannya. Munculnya kegiatan mobile banking mengharuskan Bank untuk menerapkan Good Corporate Governance untuk memuaskan kepentingan para pemegang kepentingannya dan khalayak umum. Teori Sistem Hukum yang digagas oleh Lawrence M. Friedman yang terdiri dari Legal Structure, Legal Substance dan Legal Culture digunakan untuk melihat dan menentukan apa yang menjadi kunci dalam penerapan Good Corporate Governance pada kegiatan mobile banking khususnya dalam lingkup hukum Perbankan Indonesia. Dengan menggunakan penelitian hukum normatif menggunakan metode wawancara, Penulis melihat kenyataan di lapangan melalui sudut pandang sumber hukum primer yang memiliki pengalaman khusus terkait bidang ini. / The growth of banking activities encourages the need for the Bank to implement good management in its operational aspects when resolving doubts of its stakeholders. The emergence of mobile banking activities requires the Bank to implement Good Corporate Governance to satisfy the interests of its stakeholders and the general public. The Legal System Theory, which was initiated by Lawrence M. Friedman, which consists of Legal Structure, Legal Substance and Legal Culture, is used to see and determine what is the key to implementing Good Corporate Governance in mobile banking activities, especially in the scope of Indonesian banking law. By using normative legal research Using the interview method, the author sees the reality on the ground through the point of view of primary legal sources who have special experience in this field.
