Abstract

Tesis ini membahas eksistensi Majelis Kehormatan Notaris dalam memberikan perlindungan terhadap Notaris sebagai pejabat umum. Sebagaimana diatur dalam Pasal 66 dan 66A Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang 30 Tahun 2004 tentang Jabatan Notaris. Majelis Kehormatan Notaris mempunyai kewenangan untuk melaksanakan pembinaan Notaris dan kewajiban memberikan persetujuan atau penolakan untuk kepentingan penyidikan dan proses peradilan, pengambilan fotokopi minuta akta serta pemanggilan Notaris untuk hadir dalam pemeriksaan yang berkaitan dengan akta atau protokol Notaris yang berada dalam penyimpanan Notaris. Kewenangan ini sebelumnya dimiliki oleh Majelis Pengawas Daerah, namun dihapuskan oleh Mahkamah Konstitusi berdasarkan Putusan No. 49/PUU-X/2012. Dalam hal persetujuan atau pengambilan fotokopi minuta akta dan pemanggilan Notaris diperlukan keobjektifan Majelis Kehormatan Notaris. Majelis Kehormatan Notaris dalam menjalankan kewenangannya tidak dipengaruhi oleh pihak atau lembaga lainnya, sehingga keputusan yang dihasilkan dianggap independen dan tidak dapat diganggu gugat. / This thesis discusses the existence of the Notary Honorary Council in providing protection to Notaries as public officials. As regulated in Articles 66 and 66A of Law Number 2 of 2014 concerning Amendments to Law 30 of 2004 concerning Position of Notary. The Notary Honorary Council has the authority to carry out the formation of a Notary Public and the obligation to give approval or rejection for the purposes of investigation and the judicial process, take a photocopy of the minutes of the deed and summon the Notary to attend the examination relating to the notary deed or protocol in the Notary's depository. This authority was previously owned by the Regional Supervisory Council, but was abolished by the Constitutional Court based on Decision No. 49 / PUU-X / 2012. In the case of approval or photocopy of the minutes of deed and the summoning of a Notary is required the objectivity of the Notary Honor Council. The Notary Honorary Council in exercising its authority is not influenced by other parties or institutions, so that decisions made are considered to be independent and cannot be contested.
