Abstract

Humans are social creatures who always need another people, on the other words human beings can not be separated from a legal act. Man as a frequent subject of binding law themselves with others, that one of them is transaction with another people to achive a goal, transaction can be binding if the parties make an agreement, but the general public does not really understand the importance of an agreement. Agreement is very importance to have in a transaction of any kind, which in making such an agreement would need to also concider how legitimate the terms of an agreement, the legitimate of the agreement is important because if some parties do not make an agreement refer to legitimate that is not an legitimate agreement, many case in Indonesia caused by legality of agreement, if the people want to solved the case they can use the arbitration or go to court, but if that not a big case many people will choose go to court, but sometime the court decision not in accordance with applicable law, by this thesis, I would like to elaBorate the meaning of legitimate agreement become more obvious and I would like to analyzing Supreme Court’s Decision Number: 1594 K/PDT/2010.
