Abstract

Akta autentik merupakan alat bukti terkuat dan terpenuh sehingga notaris harus berpegang pada prinsip kehati-hatian namun terdapat kelalaian notaris yang membuat akta perjanjian sewa menyewa tanah dan bangunan tanpa melihat dokumen asli sertifikat. Pokok permasalahannya adalah apakah bentuk kelalaian notaris memenuhi unsur perbuatan melawan hukum, bagaimana bentuk tanggung jawab notaris, dan akibat hukumnya terhadap pembuatan akta perjanjian sewa menyewa tanah dan bangunan berdasarkan putusan dalam kasus ini. Jenis penelitiannya normatif empiris dengan analisis data deskriptif kualitatif. Dapat disimpulkan bahwa bentuk kelalaian notaris memenuhi seluruh unsur perbuatan melawan hukum, yaitu: perbuatan pembuatan akta melanggar Pasal 16 ayat (1) huruf a dan huruf e Undang-Undang Jabatan Notaris (“UUJN”) serta prinsip kehati-hatian notaris; adanya kelalaian notaris karena tidak melihat dokumen asli bukti kepemilikan sebagai dasar pembuatan akta; adanya kerugian material karena status kepemilikan Penggugat atas objek sengketa; dan kerugian Penggugat sebagai akibat langsung dari akta yang dibuat notaris. Akibat hukum terhadap pembuatan akta dalam kasus ini adalah akta tersebut dinyatakan batal demi hukum serta adanya pengembalian objek sengketa dari pihak penyewa kepada Penggugat selaku pemilik sah. Bentuk tanggung jawab notaris (Tergugat IV) adalah dijatuhi sanksi perdata berupa pembayaran biaya perkara dan uang paksa secara tanggung renteng dengan Tergugat I, Tergugat II dan Tergugat III (Para Tergugat). / The authentic deed is the strongest and fullest evidence available. Notaries must adhere to the principle of prudence. However, some notaries create land and building lease without reviewing the original certificate document. The issue is whether or not such notarial neglect satisfies requirements for being considered a violation of the law, how the notary should take responsibility, and what are the legal consequences of having created land and building lease deeds according to the judgment of the case. The search is an empirical normative one, with a qualitative descriptive data analysis method. We can conclude that notarial neglect has satisfied all requirements to be considered as a law violation: I.e. in relation to Article 16 Paragraphs (1) letter a dan letter e of the Law of the Position of Notary (Undang-Undang Jabatan Notaris – “UUJN”) and the principle of prudence among notaries, the notaries have been proven to be negligent because she failed to review the original ownership documents as basis for creating the deeds; there are material losses due to the uncertain ownership status of the Plaintiff over the object of dispute; and the Plaintiff suffers direct loss due to the deed created by the notary. The legal consequence of the creation of deed in this case is that the deed is rendered null and void, and that the object of dispute must be returned by the tenants to the Plaintiff as its legal owner. The form of notarial accountability (Defendant IV) is a civil sentencing of paying the costs of the case and fines jointly with Defendant I, Defendant II, and Defendant III (the Defendants).
