Abstract

Penulisan tesis ini dilatarbelakangi oleh adanya keberatan dari pelaku pembangunan mengenai ketentuan pembatalan pembelian rumah susun dalam Permen PUPR No. 11 Tahun 2019 yang memberikan akibat hukum terhadap calon pembeli dan pelaku pembangunan yang merupakan pihak-pihak dalam PPJB. Dari latar belakang tersebut muncul permasalahan yaitu, akibat hukum pembatalan PPJB terhadap para pihak dikaitkan dengan Permen PUPR No. 11 Tahun 2019 dan tanggung jawab Notaris akibat pembatalan PPJB rumah susun. Penelitian menggunakan Metode Penelitian Normatif Empiris. Dari penelitian tersebut di atas maka dapat disimpulkan bahwa akibat hukum pembatalan PPJB rumah susun terhadap para pihak dikaitkan dengan Permen PUPR No. 11 Tahun 2019 adalah terhadap pelaku pembangunan melakukan kelalaian, maka yang bersangkutan wajib untuk menyerahkan seluruh pembayaran yang telah diterima kepada calon pembeli. Terhadap calon pembeli yang melakukan kelalaian dan tidak memenuhi kewajiban pembayaran, maka pelaku pembangunan memiliki hak untuk memotong 10% dari harga transaksi yang telah dibayarkan. Tanggung jawab Notaris akibat pembatalan PPJB dikaitkan dengan Permen PUPR No. 11 Tahun 2019 adalah Notaris tidak bertanggung jawab terhadap pembatalan PPJB, sepanjang para pihak menghendaki adanya pembatalan PPJB itu. Kedudukan Notaris dalam PPJB rumah susun terbatas hanya menuangkan kesepakatan ke dalam suatu akta PPJB, sehingga Notaris hanya bertanggung jawab terhadap bentuk formal akta otentik sebagaimana yang ditetapkan oleh undang-undang. / This thesis has a background by an objection by property developer about the provisions of cancellation of purchase on buildings that regulated on Ministry of Public Works and Public Housing Regulation No. 11 of 2019 which granted the legal consequences to prospective buyer and property developer which are the parties on Sale and Purchase Binding Agreement (PPJB). From such background, there are issues on legal consequences of PPJB to the parties in terms of Ministry of Public Works and Public Housing Regulation No. 11 of 2019 and notary liabilities on the cancellation of PPJB on Apartment Buildings. The research using the normative juridical approach method. From such above research then may be concluded that the legal consequences of the cancellation of PPJB on apartment buildings to the parties in terms of Ministry of Public Works and Public Housing Regulation No. 11 of 2019 are against the property developer who conducting negligence, then they shall to give all payments received to the prospective buyer. To prospective buyers conducting negligence and not fulfill their obligation to pay, then the property developer is entitled to deduct 10% of the transaction price paid. Notary liability due to cancellation of PPJB in terms of Ministry of Public Works and Public Housing Regulation No. 11 of 2019 are the notary is not liable to such cancellation, as long as the parties are intended to such cancellation. Notary status of PPJB on apartment buildings is limited to only concluded the agreements into a deed of PPJB, so the notary is only liable to the formal form of an authentic deed as stipulated on laws.
