Abstract

Tanah yang dijadikan jaminan pelunasan atas utang oleh suatu Lembaga Pembiayaan (Kreditur) adalah hal yang sudah biasa dilakukan. Di dalam Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan, sudah ditentukan bahwa untuk menjamin Tanah beserta benda-benda yang berkaitan dengan tanah adalah menggunakan lembaga Hak Tanggungan. Namun pada praktiknya, ternyata ditemukan suatu pengikatan jaminan utang dengan menggunakan mekanisme penandatanganan Perjanjian Pengikatan Jual Beli (PPJB) dan Akta Kuasa Jual yang dibuat di hadapan Notaris. Untuk melihat kekuatan hukum atas pelaksanaan pengikatan jaminan utang dengan mekanisme tersebut, diperlukan penelitian mengenai implementasi dari pengikatan dengan menggunakan Hak Tanggungan dan implementasi dari dilaksanakannya Perjanjian Pengikatan Jual Beli (PPJB) dan Akta Kuasa Jual. Dalam penelitian ini, pengumpulan data dilakukan dengan melakukan serangkaian kegiatan studi kepustakaan wawancara langsung kepada kepala bagian Legal dari suatu Perbankan dan Staff Senior dari Kantor Notaris dan PPAT di Jakarta Barat, untuk dapat mewakili masing-masing pihak. Dari hasil penelitian tersebut, didapati bahwa pengikatan jaminan dengan menggunakan Hak Tanggungan dan penandatanganan Perjanjian Pengikatan Jual Beli (PPJB) dan Akta Kuasa Jual adalah merupakan dua hal yang berbeda dan terhadap pelaksanannya mempunyai akibat hukum masing-masing. / Land that is used as collateral for repayment of debts by a Financing Institution (Creditors) has been a widely accepted practice. Regulation Number 4/1996 Regarding Mortgage Right, it has already determined the usage of the mortgage institution in order to mortgage a land along with other properties that constitute a unity with such land. However, in the practice, it is found that a binding of debt guarantees to be used as collateral for a debt by using the mechanism of signing the Conditional Sale and Purchase Agreement (PPJB) along with Deed of Power of Attorney to Sale made before the Notary. To examine the legal force over the implementation of binding debt guarantees with this mechanism, a research is required on the implementation of the binding by using Mortgage Right and the implementation of the Conditional Sale and Purchase Agreement (PPJB) along with Deed of Power of Attorney to Sale. In this research, data collections done by conducting a series of literature study activities, direct interviews to the head of the Legal division of a Bank and Senior Staff from the Notary Office and PPAT in West Jakarta, to be able to represent each party. From such research, it is concluded that the binding of collateral using the Mortgage Rights and the signing of Conditional Sale and Purchase Agreement (PPJB) along with Deed of Power of Attorney to Sale are two different things and regarding the implementation has respective legal consequences
