Abstract

Brand is a distinguishing mark for each product and or service, so that it can be done the quality distinguish for the product and or service can similar product without any worry to choose original product and the imitation one. Brand as one of the manifestation of intellectual property right often targeted as the brand piracy and imitated by Brand piracy actors. The legal protection on Brand is only limited to the exclusive registered brand given by the Nation to the right holder of registered brand, meaning that the protection on the registered brand given since the brand registration proposal is accepted and presented in the general list of brand as one of the registered brands. Act Number 15 of 2001 Concerning Brand as one of the legal instruments having function to give legal protection to the right holder of brand to pose a threat to civil and criminal penalties. The Legal Study in this thesis uses juridicalnormative legal study methodology centered at studies on legal forms and instrument in the legal protection for right holder of brands in Indonesia / Merek merupakan tanda pembeda pagi masing-masing produk barang dan/atau jasa, sehingga terhadap barang dan/atau jasa dapat dilakukan pembedaan kualitas atas barang sejenis tanpa takut harus memilih barang yang asli dan yang merupakan tiruan. Merek yang merupakan salah satu wujud karya hak kekayaan intelektual yang seringkali dijadikan sasaran pemalsuan merek dan ditiru oleh para pelaku tindak pelanggaran Merek. Perlindungan hukum atas Merek hanya terbatas pada merek terdaftar yang sifatnya eksklusif yang akan diberikan Negara kepada pemegang hak atas merek yang terdaftar, artinya bahwa perlindungan atas merek terdaftar diberikan sejak diterimanya permohonan pendaftaran merek dan tercatat dalam daftar umum merek sebagai salah satu merek terdaftar. Undang-Undang Nomor 15 Tahun 2001 tentang Merek sebagai salah satu instrumen hukum yang berfungsi memberikan perlindungan hukum terhadap pemegang hak atas merek memberikan ancaman hukuman secara perdata dan pidana. Penelitian Hukum dalam skripsi ini menggunakan metodologi penelitian hukum yuridis-normatif dengan berpusat pada kajian mengenai bentuk-bentuk dan instrumen hukum dalam pemberian perlindungan hukum atas pemegang hak atas merek di Indonesia.
