Abstract

Inti tujuan dan kewajiban pemberian restitusi tidak lain untuk mengembangkan keadilan dan kesejahteraan korban sebagai anggota masyarakat dan tolok ukur pelaksanaannya adalah dengan diberikannya kesempatan kepada korban untuk mengembangkan hak dan kewajiban sebagai manusia. Penelitian ini menggunakan metode yuridis normatif dengan pengumpulan data yang digunakan adalah data sekunder. Hasil dari penelitian ini bahwa pelaksanaan penjatuhan sanksi restitusi kepada pelaku tindak pidana perdagangan orang menurut ketentuan Undang-Undang No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang jo Peraturan Pemerintah Nomor 7 Tahun 2018 tentang Pemberian Kompensasi, Restitusi, dan Bantuan Kepada Saksi dan Korban adalah dimulai dari sejak korban melaporkan kasus yang dialaminya kepada Kepolisian Negara Republik Indonesia setempat dan ditangani oleh penyidik bersamaan dengan penanganan tindak pidana yang dilakukan. Namun demikian dalam pelaksanaannya masih terdapat kekurangan. Hal tersebut dikarenakan hakim pengadilan lebih memilih menggunakan penggabungan perkara Pasal 98 KUHAP karena hukum acaranya dianggap lebih pasti, kuat dan fleksibel, sedangkan hukum acara mekanisme restitusi dalam Undang-Undang Perdagangan Orang, justru dijabarkan dalam bentuk Peraturan Pemerintah, yang kedudukannya tidak sejajar pengaturan dalam KUHAP. Konsep penjatuhan sanksi restitusi dalam tindak pidana lain di Indonesia tidak memiliki keseragaman, seperti dalam Undang-Undang HAM, tidak ada pengaturan tentang daya paksa kepada pelaku untuk melaksanakan sanksi restitusi tersebut. Hal yang berbeda terdapat pada Undang-Undang Terorisme yang apabila pelaku tidak membayar restitusi, maka diganti dengan penjara pengganti paling singkat 1 (satu) tahun dan paling lama 4 (empat) tahun, sedangkan pada Undang-Undang Perdagangan Orang, Pengadilan dapat memerintahkan Penuntut Umum untuk menyita harta kekayaan dari pelaku yang kemudian dilakukan pelelangan harta tersebut untuk pembayaran restitusi. / The core purpose and obligation of granting restitution is nothing but to develop justice and welfare of victims as members of the community and the measure of its implementation is to provide opportunities for victims to develop their rights and obligations as human beings. This study uses normative juridical methods with the data collection used is secondary data. The results of this study that the implementation of the restitution sanctions to perpetrators of trafficking in persons according to the provisions of Law No. 21 of 2007 concerning the Eradication of Trafficking in Persons in conjunction with Government Regulation Number 7 of 2018 concerning Provision of Compensation, Restitution, and Assistance to Witnesses and Victims, starting from the time the victim reports her case to the National Police of the Republic of Indonesia and is handled by investigators together with the handling of the investigator criminal act committed. However, in practice there are still shortcomings. That is because the court judge prefers to use a merger in Article 98 of the Criminal Procedure Code because the legal events are considered more certain, strong and flexible, while the procedural law for the mechanism of restitution in the Trafficking in Persons Act, is actually spelled out in the form of a Government Regulation, whose position is not parallel to the provisions in the Criminal Procedure Code . The concept of imposing restitution sanctions on other criminal offenses in Indonesia does not have uniformity, as in the Human Rights Act, there is no regulation on the forced power on perpetrators to carry out these restitution sanctions. There is a different matter in the Terrorism Law which, if the perpetrator does not pay restitution, is replaced with a substitute prison for at least 1 (one) year and a maximum of 4 (four) years, whereas in the Trafficking Act, the Court can order a Public Prosecutor to confiscate the assets of the perpetrators and then auction the assets to pay for restitution.
