Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan mengenai pendaftaran merek atas dasar itikad tidak baik di Indonesia menurut Undang – undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Latar belakang pemikirannya adalah untuk mengetahui mengenai aturan terhadap permohonan pendaftaran merek dan untuk mengetahui pelaksanaan perlindungan hukum bagi pemilik merek terkenal terhadap praktik pendaftaran atas dasar itikad tidak baik, yang mana analisa penelitian ini menggunakan pendekatan kasus merek terkenal yang pernah terjadi di Indonesia yaitu kasus perkara antara Nippon Wiper Blade Japan dengan Nippon Wiper Blade Indonesia. Jenis penelitian ini termasuk penelitian hukum yuridis normatif yang bersifat deskriptif analitis. Pendekatan penelitian menggunakan pendekatan perundang-undangan dan kasus. Jenis data penelitian adalah data sekunder dengan bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data berupa studi kepustakaan dan teknik analis data pada putusan perkara yang terkait. Berdasarkan hasil penelitian perlindungan hukum yang diberikan kepada pemilik Merek dagang terkenal yang diberikan oleh pemerintah memang sudah ada, namun belum efektif hal ini dikarenakan masih hanya sebatas perlindungan secara represif. Dalam hal ini, pihak-pihak pemilik Merek juga tidak cukup memiliki kesadaran untuk meningkatkan Mereknya menjadi Merek Terkenal. Permohonan pendaftaran merek harus didasari pada pertimbangan adanya Bad Faith sehingga diperlukan upaya – upaya perlindungan diantaranya upaya Preventif dan upaya Represif, yang mana hal tersebut diatur dalam Undang – undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. / This study aims to analyze the regulation regarding trademark registration based on bad faith in Indonesia according to Law Number 20 Year 2016 Regarding Trademarks and Geographical Indications. The background of his thinking is to find out about the rules on the application for trademark registration and to find out the implementation of legal protection for famous trademark owners on registration practices based on bad faith, in which the analysis of this study uses the approach of famous brand cases that have occurred in Indonesia, namely cases involving Nippon Wiper Blade Japan with Nippon Wiper Blade Indonesia. This type of research includes normative juridical legal research that is analytical descriptive. The research approach uses a statutory and case approach. The type of research data is secondary data with primary and secondary legal materials. Data collection techniques in the form of literature studies and data analysis techniques on related case decisions. Based on the research results of legal protection given to the owners of well-known Trademarks provided by the government, there are already existing, but not yet effective this is because it is still limited to repressive protection. In this case, the trademark owners also do not have enough awareness to upgrade their trademarks to famous brands. The application for trademark registration must be based on the consideration of the existence of Bad Faith so protection efforts are needed including preventive efforts and repressive measures, which are regulated in Law Number 20 Year 2016 Regarding Trademarks and Geographical Indications.
