Abstract

Sejak disampaikan dalam pidato pelantikan Presiden Joko Widodo tahun 2019, Omnibus Law Cipta Kerja menjadi bahan diskusi panjang mengenai proses pembuatan atau legislasinya maupun efektivitas pelaksanaannya. Sebagai negara dengan civil law system, menjadi pertanyaan apakah Indonesia bisa menghasilkan Undang-Undang Cipta Kerja dengan metode Omnibus Law yang merupakan produk hukum khas common law system. Untuk itu diperlukan penelitian untuk mengukur efektivitas omnibus law cipta kerja dalam menarik investasi dan meningkatkan daya saing Indonesia. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan, dengan meneliti proses legislasi dan efektivitas omnibus law dalam meningkatkan daya saing Indonesia. Dari hasil penelitian diperoleh kesimpulan bahwa RUU Omnibus Law Cipta Kerja harus ditinjau ulang dan direvisi untuk memastikan efektivitasnya dalam meningkatkan daya saing Indonesia. Proses legislasi Omnibus Law Cipta Kerja tidak bisa dilakukan dengan terburu-buru dan harus menampung masukan seluas-luasnya. Juga terbuka opsi untuk memilah menjadi beberapa RUU atau jika dibutuhkan bisa juga ditempuh dengan opsi Peraturan Pemerintah Pengganti Undang-Undang (Perppu). / Since being stated in the inauguration speech by President Joko Widodo in 2019, Omnibus Law on Job Creation has becoming subject of long discussion, whether on the process of its law making or the effectiveness on its implementation. As a civil law system country, it is on questioned whether Indonesia can produce Law on Job Creation by Omnibus law method which is distinct product of common law system country. It is why this research is needed, to measure the effectiveness of Omnibus law on Job Creation to attract investments dan leveraging Indonesia’s competitiveness. This research is gathering data by using statutes approach and comparative approach, by assessing legislative or law making process and the effectiveness of Omnibus Law on Job Creation to leverage Indonesia’s competitiveness. This research came up with conclusion that this draft of Omnibus Law on Job Creation should be reviewed more and should be done more cautiously, by absorbing more inputs from the public. It is also open to divide this Omnibus law into several drafts of law and if is really necessary, can be formed by Government Regulation in Lie of Law (Perppu).
