Abstract

Tujuan Penelitian ini untuk memberikan masukan dan pertimbangan dalam melakukan pembelian suatu rumah dari developer / pengusaha yang aman dan baik serta sehat sesuai dengan aturan yang telah ditetapkan baik oleh pemerintahan maupun perusahaan. Sehingga konsumen mengetahui mengenai kedudukan dan hubungannya dalam suatu perjanjian jual beli suatu rumah. Kemudian untuk mengetahui hubungan hukum yang timbul dalam jual beli dan pemanfaatan rumah antara konsumen dan developer tidak hanya berlangsung karena adanya perjanjian (perjanjian pengikatan jual beli) semata, tetapi juga timbul karena ketentuan undang-undang (hubungan hukum perikatan). ,Hubungan hukum tersebut berlangsung pada setiap proses/tahapan transaksi, baik tahap pra transaksi, tahap transaksi maupun tahap purna/pascatransaksi. Hubungan hukum tersebut berlangsung pada setiap proses/tahapan transaksi, sehingga perlindungan hukum harus pula diperoleh setiap konsumen dalam setiap tahapan transaksi. Perlindungan hukum atas hak-hak konsumen dalam proses tahapan jual beli dan pemilikan rumah telah diatur dalam berbagai ketentuan hukum dan perundang-undangan seperti: Kitab Undang-Undang Hukum Perdata, Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen, UndangUndang No. 4 Tahun 1992 tentang Perumahan dan Permukiman. Permasalahan sengketa yang seringkali dihadapi konsumen dalam jual beli dan pemilikan rumah, menunjukkan kecenderungan konsumen tidak menggunakan sarana penyelesaian sengketa yang ada (litigasi dan non litigasi), tetapi lebih cenderung melakukan musyawarah dengan developer. / The purpose of this study is to provide input and consideration in making a home purchase from a developer / entrepreneur that is safe and good and healthy in accordance with the rules set by both the government and the company. So consumers know about the position and its relationship in a sale and purchase agreement of a house. Then to find out the legal relationship that arises in the sale and purchase and utilization of houses between consumers and developers not only take place due to an agreement (binding sale and purchase agreement), but also arises because of the provisions of the law (legal engagement ties). The legal relationship takes place at each transaction process / stage, both pre-transaction stage, transaction stage and post / post transaction stage. The legal relationship takes place at every transaction process / stage, so that legal protection must also be obtained by each consumer in each transaction stage. Legal protection of consumer rights in the process of buying and selling stages of housing has been regulated in various legal and statutory provisions such as: Civil Code, Law No. 8 of 1999 concerning Consumer Protection, Law No. 4 of 1992 concerning Housing and Settlements. Problems with disputes that are often faced by consumers in buying and selling and owning houses, shows the tendency of consumers not to use existing dispute resolution tools (litigation and non-litigation), but rather tend to hold consultations with developers.
