Abstract

Koperasi dipandang oleh pendiri Bangsa diantaranya Mohammad Hatta sebagai sarana untuk dapat memperkuat ekonomi rakyat yang lemah dengan cara membangun perekonomian rakyat yang melarat sehingga kemiskinan dapat diubah. Tujuh dekade Indonesia merdeka, persoalan kemiskinan masih menjadi “Pekerjaan Rumah” Pemerintah. Koperasi yang diharapkan akan menjadi alat yang efektif untuk membangun kembali ekonomi rakyat yang terbelakang dan sarana pengentasan kemiskinan dihadapkan pada persoalan ketidakberdayaan. Selain itu, pasca Putusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013, koperasi tidak memiliki konsep entitas yang jelas. Hal tersebut terlihat dari gamangnya Pemerintah menentukan definisi koperasi sampai dengan struktur kelembagaan koperasi dalam berbagai undang-undang koperasi selama ini. Walaupun penentuan definisi dan struktur kelembagaan pada setiap undang-undang menunjukkan kebijakan yang hendak dicapai oleh pembentuk undang-undang namun dari lima undang-undang koperasi yang pernah ada tidak memiliki benang merahnya. Hasil penelitian menunjukkan bahwa konsep entitas koperasi yang dinarasikan dalam undang-undang secara teoritis menimbulkan contradictio in terminis sehingga tidak menggambarkan secara utuh dan penuh terkait dengan koperasi yang dimaksud dalam Pasal 33 UUD 1945. Sampai dengan saat ini belum ada konsep entitas koperasi dalam undang-undang perkoperasian yang sesuai dengan Pancasila dan UUD 1945 juga sesuai dengan teori hukum. Koperasi tidak banyak terlibat secara aktif dalam penanggulangan kemiskinan, koperasi lebih banyak ditempatkan sebagai objek pembinaan dari Pemerintah. / The cooperative is seen by the founder of the Nation, Mohammad Hatta as a tools to improve a weak people's economy by building a destitute people's economy so that poverty can be changed. Seven rounds of Indonesian independence, poverty discussion is still the Government's "Homework". The cooperative which is expected to be an effective tool for rebuilding the underdeveloped people's economy and means of alleviating poverty is faced with the helpless prosperity. In addition, after the Constitutional Court Decision Number 28 / PUU-XI / 2013, cooperatives did not have a clear entity concept. This can be seen from ambiguos The government determines cooperative definition to the cooperative institutional structure in a variety of cooperative laws and regulations so far. With high resolution and institutional structure in each of the applicable laws and regulations approved by the legislators of the five existing cooperative laws and regulations, there is no common thread. The research results showed that the concept of cooperative entities named in the laws and regulations involving contradictions in terminology so that they are not related to complete and complete matters related to article 33 of the UUD 1945. At present there is no concept of cooperative bodies in cooperative laws that are in accordance with Pancasila and the UUD 1945 Constitution are also in accordance with legal theory. Cooperatives are not much involved in poverty alleviation, more cooperatives are placed as objects of coaching from the Government
