Abstract
In the activity of goods trading and services, a trademark has a very important role in determining in existence and diff erentiaties a type of product and service which the company produces or sell. The intention is to create a healthy competitive environment. Moreover, a trademark should be registered in order to achieve legal protection from the state. In Indonesia, regulation of generic trademark are regulated in law number 20 year 2016 subsection 22 stated "For registered brands which changed into generic name, each person can submit a trademark application which uses generic name with additional word as long as there are distinguishing elements" with that being said, generic trademark can be registered as far as the differentiating element can be seen, yet these days people are left unclear about the definition of the word generic trademark. Furthermore, when a person or a legal entity want to registered its trademark that could be indicated as generic, the classification and the criteria about the generic trademark is still uncertain. This vagueness could create more sued regarding of the reques for trademark cancellations.
