Abstract

Penelitian ini membahas mengenai pemutusan hubungan kerja yang dilakukan atas dasar pandemi Covid-19 yang dikategorikan sebagai force majeure ditinjau dari Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dimana pengolahan bahan hukum dilakukan secara studi pustaka. Penelitian ini bertujuan untuk menganalisis mengenai sah atau tidaknya bentuk pemutusan hubungan kerja sepihak terhadap pekerja kontrak yang didasari oleh Pandemi Covid-19 yang dikategorikan sebagai force majeure. Hasil penelitian menunjukkan bahwa pengusaha dapat melakukan pemutusan hubungan kerja terhadap pekerja kontrak atas dasar pandemi Covid-19 yang dikategorikan sebagai force majeure berdasarkan ketentuan UU No. 13 Tahun 2003, karena pandemi Covid-19 merupakan salah satu bentuk keadaan tertentu berupa darurat bencana wabah penyakit di Indonesia yang telah ditetapkan pada konsiderans menimbang huruf C Keppres No. 9 Tahun 2020. Pekerja kontrak yang dirugikan berhak mendapatkan gaji sisa kontrak yang tersisa sesuai dengan ketentuan peraturan perundang-undangan akibat perbuatan pengusaha yang melakukan pemutusan hubungan kerja secara sepihak / This study discusses the termination of employment carried out on the basis of the Covid-19 pandemic which is categorized as a force majeure in terms of Law No. 13 of 2003 concerning Labor. This research uses a type of Normative Juridical research in which the processing of legal materials is done by literature study. This study aims to analyze whether or not the form of unilateral termination of employment of contract workers based on Pandemic Covid-19 is categorized as force majeure. The results showed that employers can terminate employment of contract workers based on the Covid-19 pandemic which is categorized as a force majeure based on the provisions of Law No. 13 of 2003, because the Covid-19 pandemic is one form of certain conditions in the form of an emergency disease outbreak in Indonesia which has been set out in consideration of letter C of Presidential Decree No. 9 of 2020. Contracted workers who are disadvantaged are entitled to get the remaining salary of the contract remaining in accordance with statutory provisions due to the actions of employers who terminate their employment unilaterally.
