Abstract

Anak yang berhadapan dengan hukum tidak dapat diberikan hukuman layaknya orang dewasa, karena hukuman yang diberikan kepada anak yang masih dibawah umur akan berpengaruh terhadap masa depan anak, kelangsungan hidup anak, kondisi psikis anak, perampasan kemerdekaan anak, dan kepentingan yang tebaik bagi anak. Oleh sebab itu di Indonesia, perlindungan hukum bagi anak yang masih di bawah umur diatur oleh Undang-Undang No. 11 Tahun 2012 tentan Sistem Peradilan Pidana Anak. Pada Tahun 2020, seorang mucikari anak yang masih dibawah umur didakwa oleh kepolisian dengan hukuman penjara paling lama 10 tahun penjara. Hukuman yang diberikan oleh pihak kepolisian tidak sesuai aturan yang berlaku di Indonesia mengenai hukuman untuk anak yang masih di bawah umur. Tugas akhir ini bertujuan untuk mengetahui hukuman yang diberikan kepada mucikari anak yang masih dibawah umur apakah sesuai dengan peraturan yang berlaku di Indonesia / Children who are faced with the law cannot be given punishment like adults, because the punishment given to minors will affect the child's future, the child's survival, the child's psychological condition, deprivation of children's freedom, and the child's best interests. Therefore in Indonesia, legal protection for children who are still minors is regulated by Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. In 2020, a pimp for a minor was charged by the police with a maximum imprisonment of 10 years. Punishments provided by the police are not in accordance with the law for children under the year in Indonesia. This final project aims to determine whether the punishment given to child pimps who is still under age is in accordance with the applicable regulations in Indonesia.
