Abstract

Penelitian ini menganalisa mengenai pertanggungjawaban bidan yang memasarkan Klinik Paseban yang melakukan praktik aborsi ilegal. Bidan-bidan yang membantu memasarkan praktik aborsi ilegal melanggar Pasal 55 KUHP Jo. Pasal 194 UU 36/2009. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dengan pengolahan bahan hukum dilakukan menggunakan studi pustaka. Penelitian ini bertujuan untuk menelaah terkait jerat sanksi terhadap sejumlah bidan yang turut membantu praktik aborsi ilegal klinik Paseban di daerah Pasar Minggu, Kota Jakarta, Klinik Paseban merupakan klinik tanpa papan nama yang telah melakukan praktik aborsi dengan skala masif. Para pengelola klinik Paseban sendiri telah terjerat pertanggungjawaban pidana sesuai dengan larangan pada UU 36/2009. Pembahasan akan mencermati pertanggungjawaban yang terfokus pada para bidan yang memasarkan klinik Paseban/This study analyzes the accountability of the midwives who market the Paseban Clinic that practices illegal abortion. Midwives who help market illegal abortion practices violate Article 55 of the Criminal Code Jo. Article 194 of Law 36/2009. This research uses the juridical normative research type with legal material processing carried out using literature study. This study aims to examine the penalties for a number of midwives who have helped the practice of illegal abortion at the Paseban clinic in the Pasar Minggu area, Jakarta City. The Paseban Clinic is a clinic without a nameplate that has carried out massive-scale abortion practices. The managers of the Paseban clinic themselves have been entangled with criminal responsibility in accordance with the prohibitions in Law 36/2009. The discussion will look at the accountability of the midwives who market the Paseban clinic.
