Abstract

Indonesia is the country with the highest e-commerce growth in the world. Ecommerce has transformed a traditional trading system into a modern trading system where buying and selling transactions can be done without the seller and buyer having to meet. Dispite all that, based from Indonesian Consumer Institution Foundation data, there’s still a lot of complaints about e-commerce problems. One of the common e-commerce problems is unilateral cancellation. Likewise with the Lazada case, as one of the e-commerce platforms that made a unilateral cancellation to Achmad Supardi. Where in the case it is still unknown whether the unilateral cancellation is an act of default or an act of tort and how ecommerce settle disputes. The purpose of this research is to analyze whether the unilateral cancellation by Lazada is an act of default or an act of tort and how ecommerce settle the disputes. The result of this research is, Lazada as e-commerce platform has made the right action and regarding dispute settelement in ecommerce, it can be resolved through litigation which is through the courts or by non-litigation such as arbitration that is popular recently.
