Abstract

This research will discuss the general notion of copyright protection regarding administrative conducts through the representation of Right Holder through Collective Management Organization. The author identifies an issue of ambiguity concerning scopes of responsibility between Collective Management Organization and the National Collective Management Organization. One issues that examplefies this was the criminal charges against PT Imperium Happy Puppy filed by Radja band group, in regards to uses of copyright, and the licensing system accounted to royalties. The research will focus on discussion and explanation towards the regulations of copyright, legal guarantee, and the operational conduct, as well as the development, of Collective Management Organization, as predefined by law, through examination and identification towards the purpose of law drafters in reciting these related articles. The analysis will compare the discussion and compare it to the process and final decision of the criminal charges at hand. The author identifies a mistake in interpretation towards the payment flow system and royalty claims. In addition, the research also outlines the relation between both private and state-owned Collective Management Organization. Through the normative perspective, this research comes into the conclusion that legal guarantees and protection of copyright in regards to regulation towards Collective Management Organization exist within the articles of copyright laws. However, the understanding of each individual concepts lacks foundational framework apart from the existing phrases of the articles.
