Abstract

The concept of authentic instrument is based on the Civil Law legal system’s concept of preventive justice. Authentic instruments are the cornerstones of the concept of “preventive justice”. The system of preventive justice complements the contentious jurisdiction. Civil Law Notary as one of the authentication officials must ensure that the authentic instruments are made through a process named authentication. As a country with Civil Law legal system, Indonesia has Civil Code and Notarial Law as the legal background to issue authentic instruments. The lack of systematic, clarity and firm written provisions related to the procedure in drawing an authentic instrument (authentication process) has created a number setbacks related to the degradation of authentic instruments. This research focuses on the authentication process on “akta partij” which will hopefully become an enlightenment and academic contribution to Civil Law Notary in Indonesia in executing their official duties. Moreover, by re-introducing preventive justice concept to Indonesia may as well bring a whole new perception and even cause a paradigm shift towards the outlook of authentic instrument and authentication. / Konsep akta autentik itu berdasarkan konsep hukum pencegahan (preventive justice concept) yang ada di sistem hukum Civil Law. Akta autentik bagaikan benteng dalam konsep hukum pencegahan. Sistem hukum pencegahan ini mengimbangi yurisdiksi lembaga pengadilan. Notaris sebagai salah satu pejabat pembuat akta autentik wajib memastikan bahwa pembuatan akta autentik dilakukan melalui proses formalitas autentik (authentication). Sebagai negara dengan sistem hukum Civil Law, Indonesia memiliki Kitab Undang-Undang Hukum Perdata dan Undang-Undang Jabatan Notaris sebagai dasar hukum pembuatan akta autentik. Keterbatasan ketentuan tertulis yang sistematis, jelas dan tegas mengenai tatacara atau formalitas pembuatan akta autentik (formalitas autentik) telah berakibat pada beberapa kejadian yang mengakibatkan akta autentik menjadi surat bawahtangan. Penelitian ini fokus pada formalitas pembuatan autentik pada akta para pihak (akta partij), dengan harapan menjadi suatu pencerahan dan kontribusi ilmiah kepada Notaris di Indonesia dalam menjalankan tugas dan jabatannya. Selain itu, peninjauan ulang mengenai konsep hukum pencegahan di Indonesia diharapkan mampu mengantar persepsi umum ataupun mengeser paradigma terhadap pandangan akta autentik dan formalitas autentik.
