Abstract

Keterbatasan tanah untuk memenuhi berbagai keperluan perumahan menyebabkan perlunya dibangun hunian tempat tinggal dalam bentuk rumah susun. Pihak pengembang berupaya mendapatkan keuntungan dengan membangun apartemen. Kenyataannya, banyak konsumen merasa dirugikan dalam pelaksanaan pengikatan jual beli. Rumusan masalah dalam tesis ini adalah: Bagaimana kesesuaian Perjanjian Pengikatan Jual Beli Puri Garden Apartemen dengan ketentuan perundang-undangan yang berlaku? Bagaimana pelaksanaan perlindungan hukum bagi para konsumen Puri Garden Apartemen? Untuk menjawab rumusan masalah diatas, penulis menggunakan penelitian hukum Normatif, dengan menggunakan data sekunder dan analisis secara kualitatif. Adapun hasil penelitian yaitu PPJB Puri Garden Apartemen sudah sesuai dengan Undang-undang No. 16 Tahun 1985 dan Undang-undang No. 20 Tahun 2011 tentang Rumah Susun, tetapi belum sesuai dengan Kep Men No. 11 Tahun 1994 tentang Pedoman Perjanjian Pengikatan Jual Beli. Walaupun sudah sesuai dengan peraturan yang berlaku, PPJB Puri Garden Apartemen ini telah merugikan para konsumen. Ini membuktikan bahwa adanya celah-celah yang dapat dilakukan pihak pengembang dalam transaksi jual-beli yang dapat merugikan konsumen. Pelaksanaan perlindungan hukum bagi konsumen Puri Garden Apartemen belum optimal karena terlihat dari kasus yang terjadi bahwa pihak konsumen yang dirugikan, padahal pemerintah sudah membuat aturan-aturan yang harus dipatuhi, tetapi tetap saja pihak pengembang dapat mencari celah untuk lepas dari tanggung jawabnya / Limitations of land to meet the various needs of housing causes the need to build a residential dwelling in the form of flats. The developer seeks to benefit the building of apartments. In fact, many consumers feel aggrieved in the implementation of the binding sale and purchase. The problem of this thesis is: What about the suitability of the Sale and Purchase Agreement Puri Garden Apartments statutory provisions applicable? How is the implementation of legal safeguards for consumers Puri Garden Apartment? To answer the formulation of the above problems, the author uses Normative legal research, using secondary data and qualitative analysis. The research results are PPJB Puri Garden Apartment is in accordance with Law No. 16 of 1985 and Law No. 20 of 2011 on the Flats, but not in accordance with the Decree No. 11 Year 1994 on Guidelines for the Sale and Purchase Agreement. Although it is in compliance with applicable regulations, the SPA Puri Garden These apartments have been detrimental to the consumer. This proves that the cracks do the developer in a transaction that could harm consumers. Implementation of legal protection for consumers Puri Garden Apartment is not optimal because it looks from the case that the consumer is harmed, though the government has made rules that must be obeyed, but still, the developer can find loopholes to escape from its responsibilities
