Abstract

Undang-undang No.18 Tahun 2008 Pasal 15 dan Peraturan Pemerintah No. 81 Tahun 2012 Pasal 12 - 15 menyebutkan bahwa dalam pelakanaan pengelolaan sampah, produsen wajib mengelola sampah atas produksinya. Kewajiban produsen tersebut lebih dikenal dengan istilah Tanggung Jawab Produsen atau ‘EPR’ (Extended Producer Responsibility). Penumpukan sampah botol PET yang terjadi menunjukan bahwa masih kurangnya penerapan Hukum yang dilakukan oleh produsen botol PET pada kegiatan usahanya di Indonesia. Disisi lain, Korsel dengan berbagai kebijakannya telah berhasil mendorong para produsen botol PET untuk menerapkan sistem EPR. Melalui penelitian hukum secara normatif-kualitatif dengan pendekatan sejarah, sistematis dan perbandingan Hukum pengelolaan sampah yang berlaku, serta mewawancarai narasumber yang berperan langsung dalam perumusan kebijakan pegelolaan sampah di Indonesia. Maka dapat disimpulkan bahwa dari sudut pandang pengalaman Korsel, upaya penegakan UU 18/2008 Pasal 15 dan PP 81/2012 Pasal 12-15 adalah dengan menentukan standarisasi target pengelolaan sampah, membentuk asosiasi daur ulang PET, melakukan pengawasan penerapan EPR, serta menentukan insentif dan disinsentif / The Act No.18 of 2008 Articles 15 and Enforcement Decree No. 81 of 2012 Article of 12 to 15 stated that in the process of wastes management, Producer is obliged to manage the wastes from its production process. This obligation is commonly known as Producer Responsibility or EPR (Extended Producer Responsibility). The accumulation of PET bottles wastes which occurred reflected some lack of law enforcement to those Producers of PET bottle that held their businesses in Indonesia. At the other side, South Korea, through its policies has managed to reinforce the Producers of PET bottle to apply the EPR system. Through this normative-qualitative study with systematic-historical approach and comparison of the existing law, Interviews with the expert that also has contribution in the creation of waste management policies in Indonesia. In the end, It could be concluded that in the South Korean point of views, The effort to uphold the Act No.18 of 2008 Article No. 15 and enforcement decree No.81 of 2012 Article No. 12-15 is to specifying the standardization target of waste management, Setting up the PET recycling association, Executing supervision on the EPR application and determining incentives and disincentives
