Abstract

Dengan berlakunya Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal (UUPM), pemerintah berharap dapat meningkatkan jumlah investasi yang ditanamkan oleh para penanam modal baik asing maupun dalam negeri, khususnya melalui penanaman modal asing langsung (foreign direct investment). Karena selain memberikan berbagai insentif serta fasilitas bagi penanam modal, UUPM ini juga menjamin adanya kepastian hukum, perlindungan, dan perlakuan yang sama antara penanam modal asing dan dalam negeri sebagai prinsip dasar dalam penyusunan kebijakan penanaman modal di Indonesia dengan tetap memperhatikan kepentingan nasional. Salah satu usaha pemerintah dalam menjaga kepentingan nasional dapat dilihat dari diterbitkannya Peraturan Presiden Nomor 44 Tahun 2016 tentang Daftar Bidang Usaha yang Tertutup dan Bidang Usaha yang Terbuka Dengan Persyaratan di Bidang Penanaman Modal. Dalam kegiatan penanaman modal di Indonesia, bisa dikatakan bahwa Peraturan mengenai Daftar Bidang Usaha yang Tertutup dan Bidang Usaha yang Terbuka Dengan Persyaratan di Bidang Penanaman Modal merupakan salah satu peraturan yang pertama kali dilihat dan terpenting bagi calon penanam modal, baik penanam modal asing maupun dalam negeri dalam menentukan bidang usaha yang akan dipilih sebelum melakukan penanaman modal, karena di dalam lampiran peraturan tersebut terdapat daftar yang mengatur mengenai bidang-bidang usaha apa saja yang terbuka untuk penanaman modal dan bidang-bidang usaha apa saja yang tertutup bagi penanaman modal / With the enactment of Law Number 25 Year 2007 regarding Investment (UUPM), the government hopes to increase the amount of investment invested by foreign and domestic investors, especially through foreign direct investment. Because in addition to providing various incentives and facilities for investors, UUPM also ensures the legal certainty, protection and equal treatment between foreign and domestic investors as a basic principle in the preparation of investment policies in Indonesia with due regard to national interests. One of the way of governmental effort in safeguarding the national interest can be seen from the issuance of Presidential Regulation No. 44 of 2016 concerning the List of Closed Business Fields and Opened Business Fields with Requirements in the Field of Investment. In investment activities in Indonesia, it can be said that the decree concerning the List of Closed Business Fields and Opened Business Fields with Requirements in the Field of Investment is one of the first and most important regulation for prospective investors, both foreign and domestic investors in determining the business sector to be chosen before investing, because inside the attachment of the decree there is a list that regulates which areas of business are opened to investment and what businesses are closed to investment
