Abstract

In practice Notary and PPAT have the precautionary principle which is offset by the honesty in making an authentic deed , in the manufacture of the Deed of Sale and Purchase Agreement, the notary shall ask the landowner to show the certificate of ownership rights over the land. Notaries are also entitled to store the certificate to the process of making the deed of sale is completed and then registered with the National Land Agency. In a case study of decision number 1 / PDT.G / 2012 / PN.LSM , a notary less cautious in deed make a binding sale and purchase. The notary does not store sertipikatnya. The parties that are not acting in good faith instead go to a different notary and asked for a certificate of Power of Attorney Imposing Encumbrance over ground objects that have previously been made Deed of Sale and Purchase Agreement . Not only that, the new Notaries provide the date on the binding sale and purchase deed when shown proof of payment, not the date of the signing of the deed. This study used a method based on a normative legal research or study literature documents taken from the material library (library research), data collection is done by using the approach of legislation and case studies. From these results, it can be concluded that the notary who proved negligent in carrying out his post should be responsible for the loss of the parties arising from the deed he made. / Dalam prakteknya Notaris dan PPAT mempunyai prinsip kehati-hatian yang diimbangi dengan kejujuran dalam pembuatan suatu akta otentik, dari itu dalam pembuatan Akta Pengikatan Jual Beli, notaris wajib meminta kepada pemilik tanah untuk memperlihatkan sertifikat hak milik atas tanahnya tersebut. Notaris juga berhak untuk menyimpan sertifikat tersebut sampai proses pembuatan akta jual beli selesai untuk kemudian didaftarkan kepada Badan Pertanahan Nasional. Dalam studi kasus putusan nomor 1/PDT.G/2012/PN.LSM, seorang notaris kurang berhati-hati dalam membuatkan akta pengikatan jual beli. Notaris tersebut tidak menyimpan sertipikatnya. Para pihak yang tidak beritikad baik malah pergi ke notaris berbeda dan minta dibuatkan akte Surat Kuasa Membebankan Hak Tanggungan atas obyek tanah yang sebelumnya sudah dibuatkan Akte Pengikatan Jual Beli. Tidak hanya itu, Notaris tersebut baru memberikan tanggal pada akte pengikatan jual beli saat bukti bukti pembayaran ditunjukkan, bukan tanggal saat penandatangan akta Dalam penelitian ini digunakan metode penelitian hukum normatif didasarkan pada literatur atau studi dokumen yang diambil dari bahan-bahan pustaka (library research), pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan dan juga studi kasus. Dari hasil penelitian tersebut, dapat disimpulkan bahwa notaris yang terbukti lalai dalam menjalankan jabatannya harus bertanggung jawab atas kerugian para pihak yang timbul dari akte yang dibuatnya.
