Abstract

In the notary daily practice, there are a lot of violation relating to The Ethical Code of Notary nowadays. The violation to The Ethical Code of Notary, such as not facing the Notary, the deed was not read or signed before the Notary, are the living law in the Notaries. It is the authority of the Honorary Council of Notary to give strict sanctions to notaries who violate the Ethical Code of Notary. The aim in this research is to detects if the authority of Honorary Council of Notary is strict enough for the notaries who violate the Ethical Code of Notary. From the research result, it can be found that the sanctions for the notaries who violate the Ethical Code of Notary are not strict enough, because that the sanction to those who violate the Ethical Code of Notary is not in the form of expulsion of becoming a notary but only an expulsion of the Indonesian Notary Association, so that it will be better if it is not only the authority of the Honorary Council of Notary, but also become the authority of the Assembly Supervisor of Notary. The Assembly Supervisor of Notary is the one who authorised to give sanction to the expulsion from becoming a notary. / Dalam praktik notaris sehari-hari, banyak ditemui variasi kejadian pelanggaran kode etik yang dilakukan oleh notaris sekarang ini. Kejadian pelanggaran kode etik notaris, yaitu tidak menghadap, akta tidak dibacakan dan tidak ditandatangani di hadapan notaris, tidak perlu dipungkiri oleh para notaris karena sudah menjadi “hukum yang hidup” (living law) dalam dunia notaris. Penjatuhan sanksi terhadap notaris yang melakukan pelanggaran etika jabatan tersebut merupakan kewenangan dari Dewan Kehormatan Notaris, namun demikian penulis ingin melakukan penelitian lebih lanjut apakah kewenangan tersebut sudah tepat. Data hasil penelitian menyatakan bahwa sanksi yang dijatuhkan oleh Dewan Kehormatan Notaris kurang berpengaruh bagi notaris, karena walaupun diberhentikan dari perkumpulan, notaris tersebut dapat tetap berpraktek dan tetap menjalankan jabatannya. Kewenangan penjatuhan sanksi terhadap notaris yang melakukan pelanggaran-pelanggaran terhadap kode etik yang berkaitan dengan akta, akan lebih baik jika hal tersebut tidak hanya merupakan kewenangan dari Dewan Kehormatan Notaris, melainkan juga menjadi kewenangan dari Majelis Pengawas Notaris. Majelis Pengawas Notaris lah yang berwenang untuk menjatuhkan sanksi berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat sampai dengan pemberhentian dengan tidak hormat dari jabatannya sebagai seorang notaris.
