Abstract

Perjanjian merupakan landasan bagi Pengusaha dan Pekerja untuk melaksanakan Hubungan Kerja dalam Perjanjian Kerja terdapat 2 (dua) jenis Perjanjian Kerja yaitu Perjanjian Kerja Waktu Tertentu dan Perjanjian Kerja Waktu Tidak Tertentu. Dalam Pasal 56, 59, dan Pasal 60 Undang-Undang No.13 Tahun 2003 Tentang Ketenagakerjaan dan Peraturan Menteri Ketenagakerjaan dan Transmigrasso Nomor : Kep. 100/MEN/VI/2004 Tentang Ketentuan Pelaksanaan Perjanjian Kerja Waktu Tertentu mengatur mengenai jenis pekerjaan dan batasan jangka waktu pelaksanaan perjanjian kerja dengan tujuan yaitu melindungi pengusaha dan pekerja dari akibat terjadi pemutusan hubungan kerja. Perjanjian kerja dalam praktek Pelaksanaan mekanisme penerapan perjanjian kerja antara Pengusaha dengan pekerja banyak ditemukan pola perjanjian kerja yang tidak sesuai dengan jenis pekerjaan dan jangka waktu yang tidak sesuai dengan peraturan perundang-undang Ketenagakerjaan, Tujuan pola perjanjian kerja adalah untuk mengindari dari jenis pekerjaan dan batasan jangka waktu perjanjian kerja serta pembayaran pesangon. Penulis menggunakan pendekatan yuridis normatif Akhir penelitian, Penulis berkesimpulan bahwa Perjanjian Kerja merupakan dasar dari Hubungan Kerja antara Pengusaha dengan Pekerjanya dimana Perjanjian Kerja telah diatur untuk jenis dan Batasan jangka waktu mengenai Perjanjian Kerja. Praktek untuk menghindari jenis dan Batasan Jangka Waktu Perjanjian Kerja oleh Pengusaha dan Pekerja merupakan pelanggaran hukum sesuai dengan Pasal 59 Undang-Undang No.13 Tahun 2003 tentang Ketenagakerjaan / The Agreement is the foundation for Employers and Workers to implement Employment Relations in the Employment Agreement there are 2 (two) types of Work Agreement that is Working Agreement of Certain Time and Working Agreement of Uncertain Time. In Articles 56, 59, and Article 60 of Law No.13 of 2003 on Manpower and Regulation of the Minister of Manpower and Transmigrasso Number: Kep. 100 / MEN / VI / 2004 Concerning Provisions on the Working Agreement on Certain Time stipulates on the type of work and Limitation of the term of the Working Agreement with the aim of protecting Employers and Workers from the consequences of Termination of Employment. Work Agreement in practice Implementation Mechanism Implementation of Working Agreement between Entrepreneur with Worker found many pattern of Work Agreement which is not in accordance with Job Type and Period which is not in accordance with Labor Law Regulation, in order to avoid the Limit of Term of Work Agreement. To find out more about the Type of Work and the Limits of the Working Agreement, the Legal Protection, and the Oversight of the Employment Agreement between Employers and Workers, the Author uses a normative juridical approach At the end of the study, the authors conclude that the Employment Agreement is the basis of the Employment Relations between the Entrepreneur and the Workers in which the Employment Agreement has been set for the Type and Limits of the Term on the Employment Agreement. The practice of avoiding the types and Limits of the Period of Employment Agreement by Employers and Workers is a violation of the law in accordance with Article 59 of the Act No.13 of 2003 concerning Manpower
