Abstract

The Indonesian Financial Services Authority (Otoritas Jasa Keuangan/ OJK) imposing fees to the financial services sector arise problematic issues to the financial services bodies including banks, capital market, insurance, pension funds and financial institutions. Persons or bodies having their activities in the financial sectors also are subject to fees imposes by OJK. Notary and solicitors being registered to OJK as professionals supporting the capital market industry are also subject to pay fees to OJK. Article 34 (2) and 37 of Law No. 21 of 2011 on Otoritas Jasa Keuangan (OJK Law) authorize OJK as an independent body under the OJK Law to impose fees as part of OJK funding besides the annual budget (Anggaran Pendapatan Belanja Negara/ APBN). Based on the Government Regulation No.11 of 2014 on Fees Impose by OJK, OJK fees shall be imposed to professional and their offices annually and transaction-based. Judicial review has been submitted to the Indonesian Constitutional Court over the OJK Law. / Otoritas Jasa Keuangan (OJK) Pengenaan biaya kepada sektor jasa keuangan menimbulkan masalah yang problematis bagi perusahaan badan jasa keuangan termasuk bank, pasar modal, asuransi, pensiun dana dan lembaga keuangan. Orang atau badan yang melakukan aktivitas di sektor keuangan juga dikenakan biaya yang dikenakan oleh OJK. Notaris dan pengacara terdaftar di OJK sebagai tenaga profesional pendukung industri pasar modal juga dikenakan biaya ke OJK. Pasal 34 (2) dan 37 UU No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan (UU OJK) mengesahkan OJK sebagai badan independen di bawah UU OJK untuk mengenakan biaya sebagai bagian dari pendanaan OJK selain tahunan anggaran (Anggaran Pendapatan Belanja Negara / APBN). Berdasarkan Peraturan Pemerintah Nomor 11 Tahun 2014 tentang Retribusi yang Dikenakan OJK, biaya OJK wajib dikenakan kepada profesional dan kantor mereka setiap tahun dan berbasis transaksi. Peninjauan kembali telah diajukan ke Mahkamah Konstitusi Indonesia atas UU OJK.
