Abstract

Alih Teknologi merupakan suatu hal yang penting dalam perkembangan teknologi, salah satu hal yang penting adalah perkembangan teknologi dalam alat utama sistem persenjataan barang Tentara. Dalam membuat produk atau menggunakan proses tersebut harus diarahkan untuk menunjang alih teknologi, penyerapan invensi dan/ atau penyediaan lapangan kerja. Kewajiban melakukan alih teknologi ini didasarkan pada perjanjian lisensi untuk menggunakan paten, dimana alih teknologi ini dibiayai oleh APBN. dalam kontrak kerjasama yang terkait dengan alih teknologi adalah adanya pasal mengenai kewajiban menyelenggarakan pelatihan dalam negeri yang mencangkup kurikulum dan berapa banyak orang yang mengikuti pelatihan, serta berapa lama pelatihan dilaksanakan. Peserta pelatihan tersebut akan mendapatkan Certificate of Training Completion. Dalam Undang-undang Paten antara lain diatur bahwa pihak pemilik paten dari luar negeri wajib mematenkan teknologinya di Indonesia. Selain itu untuk menghindari adanya pembajakan teknologi di Indonesia, khususnya dalam hal pengadaan Alutsista, yang terkait dengan alih teknologi diwajibkan adanya perusahaan perwakilan di Indonesia. Tidak adanya lembaga atau peraturan yang pasti terkait dengan alih teknologi, menjadikan komitmen alih teknologi selalu didasarkan pada kerjasama antara para pihak yang terkait. Dalamkaitan ini peraturan yang berlaku dan menjadi rujukan alih teknologi adalah Undang-undang Paten No 13 Tahun 2016 / Technology Transfer is an important matter in technological development, one of the most important thing is the development of technology in the main tool of Army's weapons system. In making the product or using the process should be directed to support the transfer of technology, absorption of invention and / or the provision of employment. The obligation to transfer technology is based on license agreement to use patent, where the transfer of technology is financed by APBN (the state’s finance). In the cooperation contracts related to technology transfer is the provision of a provision of regarding training in the country that covers the curriculum and how many people attend the training, and how long the training takes place. The training participants will receive a Certificate of Training Completion. In the Patent Law, among others, stipulated that foreign parties are obliged to patent their technology in Indonesia. In addition to avoid the existence of technology piracy in Indonesia, especially in the case of procurement of Alutsista, associated with technology transfer required a representative company in Indonesia. The absence of definite institutions or regulations related to technology transfer, making technology transfer commitments always based on cooperation between the parties concerned. In relation to this matter the applicable regulations and the reference of technology transfer are the Patent Law No. 13 of 2016
