Abstract

Land is closely linked to the people’s lives. Relationship between land and people cannot be taken out despite changes in the society. Land that is physically controlled by a person does not mean that the person owns the land. Land Certificate is the end result of a land registration process that provides legal certainty and legal protection for the land owner. Land Certificate acts as a proof of rightful ownership that has legal standing as governed in Government Regulation Number 24 Year 1997 as long as physical and judiciary data in the Land Certificate can be proven to be accurate. Land disputes often arise between Land Certificate and Land Title of Ownership holders due to inaccuracy of physical and judiciary data. In this research, data collection was conducted through legal approach, i.e., an approach to various regulations on land and Land Certificate registration processes. A judge’s rulings/verdicts on disputes between Land Certificate and Land Title of Ownership holders shall refer to Acts and Regulations so that legal certainty can be achieved. The fact that Land Certificate has legal standing must be accepted by all parties. A judge must carried out comprehensive checks on physical and judiciary data of the disputed land so that accurate rulings can be meted out. / Keberadaan tanah dalam kehidupan manusia selalu terkait erat, hubungan manusia dan tanah menjadi tidak terpisahkan meskipun terjadi suatu perubahan atas perkembangan manusia. Tanah yang dikuasai secara fisik oleh perorangan tidak serta merta membuat orang tersebut dianggap memiliki tanahnya. Sertipikat adalah hasil akhir dari proses pendaftaran tanah yang memberikan kepastian hukum dan perlindungan hukum bagi para pemilik tanah. Sertipikat sebagai tanda bukti hak yang mempunyai kekuatan pembuktian yang kuat diatur dalam Peraturan Pemerintah Nomor 24 Tahun 1997, sepanjang data fisik dan data yuridis yang termuat di dalamnya dapat dibuktikan kebenarannya. Sengketa tanah banyak terjadi antara pemegang sertipikat dengan pemegang girik, seringkali diakibatkan karena data fisik dan data yuridis tidak akurat. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan, yaitu pendekatan yang dilakukan terhadap berbagai aturan hukum mengenai pendaftaran tanah dan sertipikat. Pertimbangan Hakim dalam memutuskan sengketa tanah antara pemegang sertipikat dengan pemegang girik, seharusnya tetap mengacu dan berpedoman pada ketentuan perundang-undangan sehingga tercapai kepastian hukum. Bahwa sertipikat mempunyai kekuatan pembuktian yang kuat harus diterima oleh semua pihak, yang harus dilakukan oleh Hakim adalah pengecekan data fisik dan data yuridis dengan cermat, agar diperoleh kebenaran yang menjadi dasar penentuan putusan di pengadilan.
