Abstract

Jumlah penduduk Muslim di Indonesia adalah yang terbesar di dunia saat ini. Hal ini menjadikan Indonesia sebagai negara dengan jumlah permintaan kuota haji tertinggi. Keinginan masyarakat untuk menunaikan ibadah haji sering menghadapi kendala, seperti biaya haji yang mahal, waktu tunggu keberangkatan haji yang sangat lama, terbatasnya kuota haji yang diberikan oleh pemerintah Arab Saudi, dan kurangnya pengetahuan masyarakat tentang proses pendaftaran dan pelaksanaan ibadah haji. Hal itu membuka peluang bagi pelaku penipuan calon jamaah haji yang mengakibatkan kerugian besar. Penyelenggaraan ibadah haji di Indonesia berdasarkan implementasi Undang-Undang Nomor 13 Tahun 2008 tentang Penyelenggaraan Ibadah Haji dapat dikatakan belum maksimal, karena pada kenyataannya banyak kasus penipuan yang juga dilakukan oleh karyawan Kementrian Agama, dan juga aparatur Negara. Hal yang paling penting untuk mencegah penipuan bagi para calon jamaah haji adalah dengan melakukan sosialisasi kepada seluruh masyarakat tentang proses penyelenggaraan haji, biaya haji, dan juga berbagai pengetahuan hukum tentang haji. Sosialisasi dapat dilakukan melalui media massa dan dipromosikan oleh pemerintah, tokoh masyarakat dan tokoh agama, dengan tujuan agar masyarakat dapat melindungi diri mereka sendiri dari berbagai modus penipuan. Kesimpulan dari penelitian ini, penyelenggaraan ibadah haji di Indonesia masih belum bisa dikatakan efektif dan efisien, karena ada banyak pelanggaran atas penyelenggaraan ibadah haji yang tidak sesuai dengan undang-undang penyelenggaraan ibadah haji. Saran dari penelitian ini adalah untuk mengevaluasi dan melakukan perombakan besar-besaran di semua tingkat personil di Kementerian Agama, diberikan hukuman yang berat bagi para pelaku penipuan terhadap calon jamaah haji sehingga menimbulkan efek jera, dan juga mendidik masyarakat untuk menyadari hukum / Indonesian Muslim population is the largest in the world today. This makes Indonesia the country with the highest number of requests for Hajj quota. People's desire to perform the pilgrimage often face constraints, such as costs of expensive pilgrimage, Hajj departure waiting time is very long, giving the Hajj quota of the government of Saudi Arabia is limited, and the lack of public knowledge about the registration process and the implementation of the pilgrimage. It opens up opportunities for fraud mode pilgrims which resulted in large losses. The organization of the Hajj in Indonesia under the laws, organizing the Hajj can be said to be effective but not efficient, because in fact many cases of fraud affecting pilgrims also stiffened by Minister of Religion employee, as well as the state apparatus. The most important thing to prevent fraud for pilgrims is to conduct socialization to the whole society about the process of organizing the Hajj, the pilgrimage costs, and also a variety of legal knowledge about the Hajj. Socialization can be done through the mass media and promoted by the government, public figures and religious leaders, with the aim of enabling the public to protect themselves from various modes fraud. Conclusions of this study, the hajj in Indonesia still cannot being said as effective and efficient, because there are many violations of the implementation of the pilgrimage which is not in accordance with the laws organizing the pilgrimage. Suggestions of this study was to evaluate and massive overhaul at all levels of personnel in the Ministry of Religion, given severe punishment so that no deterrent for the perpetrators of fraud pilgrims, and also educate the community to be aware of the law
