Abstract

Before the proclamation of Indonesian independence, the adoption institute regulation stipulated in Gazette 1917 No. 129 reserved for the Chinese Foreign Eastern group, while that for the indigenous groups still use the Customary Law and Islamic Law. In the aftermath of the proclamation of Indonesian independence, still has not happened unification of the institutional regulation as the institute of adoptions regulated in two (2) regulation that is regulation Law of the Republic of Indonesia and Gazette 1917 No. 129 which is still valid to this day. The role of notaries in the institute of adoption which refers to the Gazette 1917 No. 129 is important as the validity of the adoption of this simply by a notary deed and this requirement is an absolute requirement which, if not fulfilled, the result is null and void. While the provisions of the regulatory product Law of the Republic of Indonesia provides an important role for the court to authorize the appointment of children in the form of assessment or judgment. Although laws and regulations no longer provides an important role in the process of adoption, but the role of notaries should be needed in the process of adoption. With the notary deed in the process of adoption is very helpful for the court to grant the petition of adoption. This is because the notary deed is the authentic act which is has the strength of evidence was perfect, so the court will be easier and faster to examine and decide upon the petition of adoption. / Sebelum proklamasi Kemerdekaan Indonesia, pengaturan lembaga pengangkatan anak diatur dalam Staatblad 1917 Nomor 129 yang diperuntukkan bagi golongan Timur Asing Tionghoa, sementara itu untuk golongan pribumi masih menggunakan Hukum Adat dan Hukum Islam. Pada masa setelah proklamasi Kemerdekaan Indonesia, masih belum terjadi unifikasi terhadap pengaturan lembaga pengangkatan karena proses pengangkatan anak diatur dalam 2 (dua) peraturan yaitu peraturan Undang-Undang Republik Indonesia dan Staatblad 1917 Nomor 129 yang masih berlaku hingga saat ini. Peranan notaris pada lembaga pengangkatan anak yang mengacu pada Staatblad 1917 No. 129 sangatlah penting karena sahnya pengangkatan anak ini cukup dengan akta notaris dan syarat ini merupakan syarat mutlak yang apabila tidak dipenuhi maka berakibat batal demi hukum. Sedangkan ketentuan dalam produk peraturan Undang-Undang Republik Indonesia memberikan peranan penting kepada pengadilan untuk mengesahkan pengangkatan anak dalam bentuk penetapan atau putusan. Walaupun peraturan perundangan tidak lagi memberikan peranan penting dalam proses pengangkatan anak, namun peranan notaris sebaiknya tetap diperlukan dalam proses pengangkatan anak. Dengan adanya akta notaris dalam proses pengangkatan anak sangat membantu bagi pengadilan untuk mengabulkan permohonan pengangkatan anak. Hal ini karena akta notaris merupakan akta otentik yang memiliki kekuatan pembuktian yang sempurna, sehingga pengadilan akan lebih mudah dan cepat dalam memeriksa dan memutus permohonan pengangkatan anak.
