Abstract

The provisions 1 paragraph 2 of the Law of the Republic of Indonesia Number 10 of 1998 on the Amendment of the Law of the Republic of Indonesia Number 7 of 1992 concerning Banking stated that banks are business entities that raise funds from the public in the form of deposits, and distribute it to the public, in order improve the standard of living of the people. Considering the importance of the credit funds in the development process, it should if the giver and the recipient of credit and other relevant parties have protection through a strong guarantee rights institutions and which can provide legal certainty for all interested parties. In Article 51 of the Law of the Republic of Indonesia Number 5 of 1960 on the Basic Regulation of Agrarian already provided strong guarantee rights institutions, namely the Mortgage that can be imposed on the right to land in lieu hypotheek and credietverband. During the 30 (thirty) years since the enactment of the Basic Agrarian Law, Mortgage institution is not able to function properly, because there are no laws or regulations governing comprehensively. Power of Attorney Imposing Mortgage (SKMHT) is a power of attorney granted to the creditor Mortgage giver as a receiver to charge Encumbrance over the object. SKMHT a special power of attorney that authorizes the lender to impose any encumbrance. Principally same as the legal acts of the parties to the imposition of the Power of Attorney Imposing Mortgage (SKMHT) done before PPAT set forth in the Deed Power of Attorney Imposing Mortgage (SKMHT) which has been prescribed form (format) the contents in advance by the National Land Agency (BPN). The binding is accomplished by assurance order to banking Act SKMHT have legal certainty in accordance with the provisions of the Law of the Republic of Indonesia Number 10 of 1998. SKMHT a power of attorney given by the owner of collateral to the creditor as a condition for binding guarantees in obtaining credit facilities from lenders. The practice of signing the Power of Attorney Imposing Mortgage based certificate on behalf of the testator after signing the Credit Agreement was followed by signing a Power of Attorney Imposing Mortgage. Many steps that must be met prior to their right switchover registered file in the National Land Agency. That is if the binding process with the bank guarantee on condition that the certificate is still registered in the name of the heir, risk creating legal loopholes that can be performed by the debtor. / Ketentuan Pasal 1 angka 2 Undang-Undang Republik Indonesia Nomor 10 Tahun 1998 tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 7 Tahun 1992 tentang Perbankan menyatakan bahwa bank adalah badan usaha yang menghimpun dana dari masyarakat dalam bentuk simpanan, dan menyalurkannya kepada masyarakat, dalam rangka meningkatkan taraf hidup rakyat banyak. Mengingat pentingnya dana perkreditan tersebut dalam proses pembangunan, sudah semestinya jika pemberi dan penerima kredit serta pihak lain yang terkait mendapat perlindungan melalui suatu lembaga hak jaminan yang kuat dan yang dapat memberikan kepastian hukum bagi semua pihak yang berkepentingan. Dalam Pasal 51 Undang-Undang Republik Indonesia Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria sudah disediakan lembaga hak jaminan yang kuat, yaitu Hak Tanggungan yang dapat dibebankan pada hak atas tanah sebagai pengganti hypotheek dan credietverband. Selama 30 (tiga puluh) tahun lebih sejak mulai berlakunya Undang-Undang Pokok Agraria, lembaga Hak Tanggungan tersebut belum dapat berfungsi sebagaimana mestinya, karena belum adanya undang-undang atau peraturan yang mengatur secara komprehensif. Surat Kuasa Membebankan Hak Tanggungan (SKMHT) adalah surat kuasa yang diberikan pemberi Hak Tanggungan kepada kreditur sebagai penerima Hak Tanggungan untuk membebankan Hak Tanggungan atas objek Hak Tanggungan. SKMHT merupakan surat kuasa khusus yang memberikan kuasa kepada kreditur untuk membebankan hak tanggungan saja. Bahwa pada prinsipnya sama mengenai perbuatan hukum para pihak atas pembebanan Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang dilakukan dihadapan PPAT dituangkan dalam Akta Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang mana telah ditentukan bentuknya (format) isinya terlebih dahulu oleh Badan Pertanahan Nasional (BPN). Pengikatan jaminan ini dilakukan dengan Akta SKMHT agar perbankan mempunyai kepastian hukum sesuai dengan ketentuan dalam Undang-Undang Republik Indonesia Nomor 10 Tahun 1998 tentang Perbankan. SKMHT ini merupakan surat kuasa yang diberikan oleh pemilik jaminan kepada kreditur sebagai syarat untuk pengikatan jaminan dalam memperoleh fasilitas kredit dari pihak kreditur. Praktek penandatanganan Surat Kuasa Membebankan Hak Tanggungan berdasarkan sertipikat atas nama pewaris adalah setelah penandatanganan Perjanjian Kredit diikuti dengan penandatanganan Surat Kuasa Membebankan Hak Tanggungan. Banyak tahapan yang harus dipenuhi terlebih dahulu sebelum berkas didaftarkan peralihan haknya di Badan Pertanahan Nasional. Artinya jika dalam proses pengikatan jaminan pada bank dengan kondisi sertipikat yang masih terdaftar atas nama pewaris, beresiko menimbulkan celah hukum yang dapat dilakukan oleh debitur.
