Abstract

Indonesia applies the National Land Law in regulating the land as stipulated in Law Number 5 of 1960 on the Regulation of Agrarian Principles. The implementation of the mentioned regulation has not being applied properly. Yet, the discrepancies of the regulation is found through the claim against the building ownership in other Freehold Estate. PT Cholorida Batteries Indonesia 9 (Defendant 1) has been the holder of Right to Build in the Freehold Estate of Sin Saw Wa since 1977 and its period has been extended in 2007; come out with a legal claim against the building ownership from Fince Sondakh (Plaintiff) as the heir of his late father, Pieter Sondakh. The Plaintiff claimed that the land ownership of his father was never transferred to other party so that the building ownership owned by the Defendant I is against the law. Article 32 paragraph (2) Government Regulation Number 24 of 1997 on Land Registration states that within five years from the issuance of the certificate and there is no party taking legal action against the land ownership, the said right is considered expired. The conclusion derives from the applicable land regulation is Indonesia land regulation still covers minor protection of the building ownership standing in others Freehold Estate, therefore such regulation iss required to the Article 24 paragraph (4) of Government Regulation Number 40 of 1996 concerning the establishment of Minister Decision in connection with the Right to Build above the Freehold Estate. / Indonesia menerapkan Hukum Tanah Nasional dalam mengatur pertanahan sebagaimana diatur dalam Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria. Pelaksanaan peraturan perundangundangan ini belum berjalan dengan semestinya. Masih terdapat ketidaksesuaian seperti gugatan terhadap kepemilikan bangunan diatas hak milik. PT Cholorida Batteries Indonesia (Tergugat I) telah memiliki sertifikat Hak Guna Bangunan atas Sertifikat Hak Milik Sin Saw Wa sejak Tahun 1977 dan telah diperpanjang pada tahun 2007 dan terdapat gugatan atas kepemilikan bangunan tersebut dari Fince Sondakh (Penggugat) selaku ahli waris dari almarhum ayahnya, Pieter Sondakh. Penggugat menyatakan bahwa atas tanah hak milik ayahnya tidak pernah dialihkan ke pihak lain sehingga kepemilikan bangunan milik Tergugat I adalah melawan hukum. Pasal 32 ayat (2)PP Nomor 24 tahun 1997 tentang Pendaftaran Tanah menyatakan bahwa dalam waktu lima tahun sejak diterbitkannya sertifikat tidak ada pihak yang melaksanakan gugatan atas suatu hak atas tanah maka gugur kesempatan melakukan gugatan tersebut. Dari ketentuan peraturan perundangundangan tersebut, dapat disimpulkan bahwa belum adanya perlindungan bagi kepemilikan bangunan yang berdiri di atas tanah hak milik pihak lain dan oleh karena itu perlu diadakannya peraturan sesuai instruksi Pasal 24 ayat (4) Peraturan Pemerintah Nomor 40 Tahun 1996 tentang dibentuknya keputusan Menteri terkait hak guna bangunan di atas hak milik.
