Abstract

Law No. 2 of 2014 regarding Amendment to Law No. 30 of 2004 regarding Notarial Profession (UUJN) was created to ensure legal certainty, order, and protection by means of authentic written evidence concerning deeds, agreements, stipulations, and legal events made before or by a Notary. The authentic deeds made by a Notary shall meet the form and procedure as stipulated by UUJN to obtain the authentic character of the deed, by the inclusion of, for example, identities of parties, drawing up contents of an agreement desirous by the parties, signing a deed, and reading it out before an appearer and 2 (two) witnesses. A draft of the deed which has been drawn up in the form of conceptual minutes of the deed draft before execution shall firstly be read out before the appearer and witnesses by the Notary who has drawn up the deed. The Notary shall read out the deed before the appearer and attended by at least two witnesses, which deed shall have to be signed immediately by the appearer, witnesses and Notary himself. The obligation is, in principle, a must-have. The purpose of the reading out of the deed is to allow the awareness of any of the parties of the contents of the deed since the contents thereof constitute the desire of the parties. The reading out of the deed is also conducted to avoid any of the parties from being taken advantages should there be any information or editorial of the deed which is burdensome or detrimental to the other party. This research has been conducted by using a normative method. From the result of the research, it can be concluded that the legal consequences of the Notarial deed which is not read out by the Notary in his profession before the appearer shall cause the degeneration of the deed to become a privately drawn-up deed, specifically, concerning a formal agreement in which a Notarial Deed has to be drawn-up, then, the agreement shall become void by law, The Notary concerned may personally face a penalty in the form of a reprimand, warning, suspension (temporary dismissal) from the membership of an Association or Onzetting (discharge) of the membership of an Association, or a dishonorable discharge from the membership of an Association, whereas, the Notary concerned may be held accountable under a civil law. / Undang-Undang No. 2 Tahun 2014 tentang Perubahan Undang-Undang No. 30 Tahun 2004 tentang Jabatan Notaris (UUJN) lahir untuk menjamin kepastian, ketertiban, dan perlindungan hukum dengan sarana alat bukti tertulis yang bersifat autentik mengenai perbuatan, perjanjian, penetapan, dan peristiwa hukum yang dibuat di hadapan atau oleh Notaris. Akta autentik yang dibuat oleh Notaris harus memenuhi bentuk dan tata cara yang ditentukan oleh UUJN agar tercapai sifat autentik dari akta itu, misalnya mencantumkan identitas para pihak, membuat isi perjanjian yang dikehendaki para pihak, menandatangani akta, dan membacakannya di hadapan penghadap dan 2 (dua) orang saksi. Rancangan akta yang sudah dibuat berupa konsep minuta akta sebelum penandatanganan terlebih dahulu dibacakan dihadapan para penghadap dan saksi-saksi yang dilakukan oleh Notaris yang membuat akta tersebut. Notaris wajib membacakan akta dihadapan penghadap dengan dihadiri oleh paling sedikit dua orang saksi dan ditandatangani pada saat itu juga oleh penghadap, saksi-saksi dan Notaris itu sendiri. Kewajiban tersebut pada prinsipnya merupkan hal yang harus dilakukan. Tujuan pembacaan akta ini adalah agar para pihak saling mengetahui isi dari akta tersebut sebab isi dari akta itu merupakan kehendak para pihak. Pembacaan akta ini juga dilakukan agar pihak yang satu tidak merasa dirugikan apabila terdapat keterangan atau redaksi akta yang memberatkan atau merugikan terhadap pihak yang lain. Dalam penelitian ini, menggunakan metode normatif. Dari hasil penelitian tersebut, dapat disimpulkan bahwa akibat hukum terhadap akta Notaris yang dalam jabatannya tidak membacakan akta di hadapan penghadap mengakibatkan akta yang bersangkutan terdegradasi menjadi akta dibawah tangan, khusus terhadap perjanjian yang bersifat formil untuk dibuat oleh Akta Notaris maka perjanjian tersebut menjadi batal demi hukum. Notaris yang bersangkuatan secara pribadi dapat dijatuhi sanksi berupa Teguran, Peringatan, Skorsing (pemecatan sementara) dari keanggotaan Perkumpulan atau Onzetting (pemecatan) dari keanggotaan Perkumpulan, atau bisa juga diberhentikan dengan tidak hormat dari keanggotaan Perkumpulan, sedangkan dapat pula notaris yang bersangkutan dimintakan pertanggungjawaban secara perdata.
