Abstract

In practice, the use of the foreign language in an agreement involving Indonesian and foreign parties as regulated under the Notary Law and the Language Law remains unclear. This has caused doubt to some notaries in using foreign language in hislher notarial deed. By this thesis, rules on the use of foreign language in a notarial deed will be discussed especially comparing the provisions in the Notary Law and the Language Law. The purpose of this thesis is to analize whether provisions of the Notary Law and the Language Law related to the use of foreign language are consistent, so this thesis may assist notaries to apply both laws consistently. / Penggunaan bahasa asing dalam peIjanjian yang melibatkan pihak Indonesia dan pihak asing sebagaimana diatur dalam Undang Undang Jabatan Notaris maupun Undang Undang Bahasa didalam praktek masih tidak terlalu jelas pelaksanaannya. Hal ini menimbulkan keraguan dikalangan Notaris mengenai dapat tidaknya bahasa asing digunakan dalam akta. Dengan tesis ini, ketentuan mengenai penggunaan bahasa asing dalam akta akan dibahas terutama dengan membandingkan ketentuan yang ada dalam Undang Undang Jabatan Notaris serta Undallg Undang Bahasa. Tujuan dari tesis ini adalah untuk menganalisa apakah ketentuan-ketentuan dalam Undang Undang Jabatan Notaris dan Undang Undang Bahasa telah sejalan terkait dengan pellggunaan bahasa asing ini, sehingga, tesis ini dapat membantu para notaris di dalam praktek dalam menerapkan ketentuan dari kedua Undang Undang tersebut
