Abstract

Mixed Marriage is a marriage between two nationality, which one of them is Indonesian Nationality. If mixed marriage held without Prenuptial Agreement, then according to article 35 Law Number 1 Year 1974 about Marriage, there will occur mixed assets, which raised foreign element in it. Then, article 21 (3) Law Number 5 Year 1960 about Agrarian Principles will be applied, that is for an Indonesian Nationality who do mixed marriage, obtain assets such as property with the title of the Right of Ownership, the Right of Land Building and the Right of Land Cultivation, because of inheritance, transfer of rights through the sale and purchase, grant or testament, then must release his/her rights in 1 year after he/she get the right, or if not, then the right will be deleted and the land will be owned by the state. So, the Indonesian Nationality who do mixed marriage without any Prenuptial Agreement will lost his/her right to own a piece if land with the Right of Ownership, and is allowed only to have the Right to use as Foreign Nationality. But there is legal effort that can be taken by Indonesian Nationality who do the mixed marriage to get back his/her rights of land property with the Right of Ownwership title, by pleading through the district court for separation of Assets. / Perkawinan campuran merupakan perkawinan antar warga negara, dimana salah satunya adalah Warga Negara Indonesia. Apabila perkawinan campuran dilangsungkan tanpa perjanjian perkawinan, maka sesuai pasal 35 Undang-undang Nomor 1 Tahun 1974 tentang perkawinan, akan terjadi percampuran harta, sehingga timbul unsur asing didalamnya. Untuk itu diberlakukan pasal 21 (3) Undang-undang Nomor 5 Tahun 1960 tentang Pokok Agraria, yaitu Bagi Pihak Warga Negara Indonesia yang melakukan perkawinan campuran, bila memperoleh aset berupa properti tanah dengan status Hak Milik, Hak Guna Bangunan dan Hak Guna Usaha, karena pewarisan, peralihan hak lewat jual beli, hibah ataupun wasiat, maka wajib melepaskan haknya dalam jangka waktu 1 tahun sejak diperolehnya hak tersebut, atau jika tidak, maka hak akan hapus dan tanah jatuh kepada negara. Jadi, Pihak Warga Negara Indonesia yang melakukan perkawinan campuran tanpa perjanjian perkawinan akan kehilangan haknya untuk memiliki properti tanah dengan hak milik, dan hanya memperoleh hak pakai sebagaimana Warga Negara Asing (WNA). Namun ada upaya hukum yang bisa ditempuh bagi Warga Negara Indonesia yang melakukan perkawinan campuran untuk memperoleh kembali haknya atas kepemilikan properti tanah dengan hak milik, yaitu dengan memohon Penetapan Pengadilan tentang kesepakatan untuk pisah harta ke Pengadilan Negeri setempat.
